Faith-Based Government Investment

The Tampa Rail blog has responded to my post criticizing Phoenix light rail (which the Tampa folks used as a glowing example of rail success).  Remember I wrote, in part:

Look, I don't think I have ever argued that Phoenix Light Rail was run poorly or didn't have pretty trains.   And I don't know if moving 18,000 round trip riders a day in a metropolitan area of 4.3 million people is a lot or a little (though 0.4% looks small to me, that is probably just my "pre-web" thinking, whatever the hell that is).The problem is that it is freaking expensive, so it is a beautiful toy as long as one is not paying for it.  Specifically, it's capital costs are $75,000 per daily round trip rider, and every proposed addition is slated to be worse on this metric (meaning the law of diminishing returns dominates network effects, which is not surprising in this least dense of all American cities).

Already, like in Portland and San Francisco, the inflexibility of servicing this capital cost (it never goes away, even in recessions) is causing the city to give up bus service, the exact effect that caused rail to reduce rather than increase transit's total share of commuters in that wet dream of all rail planners, Portland.  Soon, we will have figures for net operating loss and energy use, but expect them to be disappointing, as they have in every other city (and early returns were that fares were covering less than 25% of operating costs).

Of course, as with all government issues, the ultimate argument is that I am some sort of Luddite for actually demanding definable results for billion dollar government spending

Sorry Coyote, save for the topic matter I'm afraid I'm just not going to be much fodder for you. We're years past 'it's an expensive tax thing'.

We know that. We know rail like any capital project is expensive to execute and expensive to maintain - in dollars. But anyone who raises the math to me will wind up with the same big 'so what'. Community investment doesn't bother everyone the same way and different people see different value. There's no way you or I cold supernaturally understand the net benefit for or against light rail. We must simply choose to believe and pick our sides.

If you believe that just because rail is expensive they aren't worthwhile, you need to explain every public vote that has gone for implementing and expanding rail systems around the world even though most operations are publicly subsidized.

Gotta run'em well, and, over time, integrate with a city, but LR is a carefree mobility solution in areas where people choose to support and pay for it.

See, they are well past my neolithic argument, into their little post-modernist world where aesthetics and political correctness trump any actual need to demonstrate money is being used well.  Though it is interesting to see him resorting to faith as a justification.

I have two words for this person -- "opportunity cost."  On one hand, the money for this project must be taken out of private hands to build the rail line -- even leaving out the substantial individual liberties questions here, there is still some obligation to demonstrate the money is better used than it would have been in the private hands from which it is taken.  Ditto, by the way, for the stimulus bill.   On the other hand, to the extent that one wishes to spend government money to move people from A to B, one needs to demonstrate that this method is better than others.  I would argue high speed rail fails both tests.

On What Freaking Basis?

Tampa Rail writes (hat tip to a reader):

The new Phoenix light rail system is emerging as one of the most successful new systems in the country.  This is especially poignant for Tampa because in scale, project scope, and demographics, Phoenix represents the apogee of operating examples.

Over the course of its first year the system has received high marks in community integration, stunning ridership figures, and respectful financial constraint (making tough decisions on long-term planning that do not inhibit the value of its starter-line status today).  This is exactly what Hillsborough County is shooting for in its own implementation.  A perfect balance of conservative control and benchmarking combined with progressive action and democratic freedom, the latter which may finally come to Hillsborough County in the form of a referendum.  That all good stuff was achieved by such a strikingly similar auto-depenent culture is a great omen.  A starter light rail system can be championed by civic conservatives (Mark Sharpe), and civic progressives (Ed Turanchik) to great outcome....

Both pieces I link to here embarass anti-rail or anti-tax groups who are, as the Phoenix article notes, "muted" if not definetively silenced.  Their arguments against community investement were loud, often intelligent (once one bought into the ideological premise that rail systems must 'pay for themselves' and that community investement is somehow inherently evil - points not firmly established by any means among rationale individuals), and grossly atypical.  I will forever hype on how mechanical, unchanging, and how pre-web these attacks were formulated.

PS- I get a lot of comments that I have some weird anti-train bias.  Actually, I have an n-scale model railroad in one room of my house, and spent a lot of my teenage years traveling along rural rail lines and photographing trains.  I love trains.  I just don't like stupid investments.

PPS- I was just thinking, on the basis the Tampa writer declares the building of Phoenix Light Rail a raving success, I could say the same thing about buying a super-size 100" flat screen TV for $50,000.  It is beautiful.  Everyone who sees it will love it.  It works flawlessly.  Lots of people will be able to enjoy it at one time.  In fact, it is the greatest, most sensible and successful purchase of all time as long as you never mention the cost.  Which is, by the way, why only one person I have ever met has one (I happened to be at a Reason reception the other night and the homeowner had such a beauty on his living room wall).

Update: I try to anticipate every argument in these posts.  The one other argument is that rails takes congestion off roads.  But for most of its length, Phoenix light rail displaced one lane of road in each direction.  These lanes had a capacity as large or larger than what Phoenix light rail carries.  The were also much cheaper to build.  I must say I liked my quote from that post

If running trains requires, as you suggest, draining resources from millions of people just to move thousands, how is it sustainable?

Mixed Decision on Government Subidies, Mostly Good News

Unfortunately:

The Arizona Supreme Court today unanimously reversed an appellate court ruling on the CityNorth case, saying it erred when it deemed the city of Phoenix's $97 million subsidy of the shopping center unconstitutional.

I discussed this in great depth in a series of posts, including this one.  The purpose of the subsidy was to try to get Nordstrom's to move their planned store about 1 mile from a development planned in Scottsdale over the line to a development planned in Phoenix  (the public cover story was to provide parking for a park and ride).

Fortunately, the ruling seems to be more procedural than anything else, and seems to slam the door in the face of similar private subsidies in the future:

Indeed, in today's unanimous decision, penned by Chief Justice Andrew D. Hurwitz, the five Supreme Court judges say that indirect public benefits -- like, apparently, beating out Scottsdale for the sale tax from Bloomingdales -- aren't enough to justify a giveaway to a private party.

Previous courts who've held that, they say, have misread precedent.

"In short, although neither [of two Supreme Court precedents] held that indirect benefits enjoyed by a public agency as a result of buying something from a private entity constitute consideration, we understand how that notion might have been mistakenly inferred from language in our opinions," they say. Now that they've clarified, the justices seem to be saying, the appellate court must examine whether the direct benefit the city of Phoenix gets -- aka. those parking spaces -- is enough to justify the giveaway.

For the record, the Supreme Court suggests that the parking garage is not, likely, benefit enough to justify such a tax giveaway.

"We find it difficult to believe that the 3,180 parking places have a value anywhere near the payment potentially required under the Agreement," its opinion finds. "The Agreement therefore quite likely violates the Gift Clause."

Kudos to the Goldwater Institute for continuing to push this issue.

Arizona Parks Privitization

The AZ Republic has an editorial today saying that privatization is not the answer for the Arizona State Parks budget woes.   On the plus side, they did actually call me for my opinion yesterday before they published it.  On the down side, they ignored everything I said.  Here is my response:

I run one of the larger private parks management companies in the country, which is based right here in Phoenix. Like many Arizona residents, I am a frequent visitor to our state parks and am sympathetic to their current budget pain. Further, I am not one to offer up privatization as a panacea for all the park's woes -- the state parks organization fulfills a variety of public missions that cannot be undertaken well privately. But I think you missed a couple of important considerations in your editorial today counseling against privatization options.

First, from my experience with public recreation agencies around the country, these budget pressures on parks organizations never really end. Recreation is almost always a key pawn in budget fights, and even if Arizona State Parks funding is restored this year, we likely will be fighting the same battles in a few years. Private concession management of parks has the advantage of taking parks off the budget, so they no longer can fall victim to budget fights. For example, in the famous 1995 federal government shutdown, private concession run facilities in the US Forest Service were the only federal recreation options that remained open through the whole budget battle.

Second, while small low-visitation parks, on a standalone basis, may not represent a very good business opportunity, there are a variety of ways to handle privatization of smaller parks. We run approximately 175 public parks and campgrounds across the country, and well fewer than half of these stand on their own as private business opportunities. But many public agencies have learned to package smaller, low-visitation parks with higher-visitation parks into multi-park packages that both provide operators a business opportunity as well as meet the public's goal of keeping all of its parks open. Further, states like California have found many creative ways to keep historic sites open using private management. These solutions, at places like Columbia State Park, not only keep historic buildings open to the public but also create events and services that bring history alive and make it more interesting, particularly to children.

I know that private management is often sloughed off with statements like, "they would just build a McDonald's or put in a bunch of billboards." But thousands of parks nationally are managed privately, and this never happens. In part, this is because business people should get some credit for intelligence, and they understand what attracts people to outdoor parks in the first place and don't want to mess with the ambiance. In addition, we often have 100+ page operating agreements in place that carefully set out the quality of our services and the approvals we must obtain to make any changes to the facilities.

Further, it is sometimes suggested that private companies would just jack up the price. Well, Arizona State Parks is proposing to raise the Slide Rock entrance fee to $20. In contrast, we run nearby picnic and day use areas at places like Grasshopper Point and we rapacious capitalists only charge $8.

I am not advocating that Arizona State Parks turn off the lights and throw the keys to a private company; but I do think that private concession management could offer a piece of the long-term solution to keeping state parks open, both now and in future budget battles.

Earthquake?

Probably not a big deal in California, but they are unusual in Phoenix.   My office was just shaking around some.

Update: Yes, 5.9 in Northwest Mexico.   Article is a bit funny, as observers on ground floors accuse observers in tall buildings of lying about feeling the earthquake.

Water Prices

Another on trying to balance water supply and demand in the state with only a one-sentence mention of water rates.

Over the years, some communities have tried to reduce demand. Years ago, Tucson devised a set of water rates that escalated steeply with use. As a result, many people simply stopped planting grass or other thirsty landscaping.

Amazingly, it is the only thing in the whole article that has been demonstrated to work, but still the author leans towards land-use planning and goofy dictats like rainwater harvesting rather than raising rates as a way of managing water supply and demand.

Why We May Be Stuck With Joe Arpaio

Conor Friedersdorf at Andrew Sullivan's blog has a number of comments from Arizona readers about why, despite all his nuttiness and outright hostility to civil rights, Joe Arpaio just keeps on getting elected here in Phoenix.

One sample:

...Arpaio is media-savvy, and picks his enemies well.  By this I don't mean his foes in county government or in the media, I mean the groups on whom he concentrates the resources of his office.  Last night, as every year about this time, all of the TV stations showed footage from this year's deadbeat dad roundup, along with the smirking Sheriff talking about how terrible it was that kids were going to have a lousy Xmas because these deadbeat dads hadn't been paying child support.  He also goes after animal cruelty cases with a vengeance.  I think he has a finely-tuned sense of which "others' are particularly viewed with scorn by his target supporters, and goes after them with a vengeance.  There is no doubt that many Maricopa county residents feel safer as a result of his policies, but also equally that his policies are never designed to impact negatively those supporters who see themselves as law-abiding (and hence won't ever be in jail), are white (and hence will never be racially profiled), and don't fit into any of the other classes that he has singled out for opprobrium.

The issue as I remember it was not of honoring Martin Luther King Jr. but of adding another paid holiday for state workers.  As I recall, Republicans readily agreed to a state holiday for MLK as long as government workers gave up one somewhere else on the calendar, so it wasn't about MLK per se but about whether government employees should be allowed an extra paid day off.

I am Willing To Believe No One is Clean

A blog that specializes in criticizing the Phoenix police argues that Judge Gary Donahoe, recent target of Sheriff Joe Arpaio, has a bad record of aiding and abetting overly-easy search warrants.  I am willing to believe that -- I think about every judge in the nation is too close to police and prosecutors on search warrant issues.  But I don't think this is why Sheriff Joe is after him.  Sheriff Joe likes to make the wrong-address no-knock raid as much as anyone, and protection of civil rights has never been in Arpaio's top 100 or so concerns.  So Danahoe may have issues, but I Sheriff Joe's charges against him are likely pure power play.

Look in the Dictionary Under Dysfunctional and You Will Find This

Taxpayers in Maricopa County (which includes Phoenix) are paying millions of dollars for officials within the county government to sue each other:

Lawsuits between county agencies including the Sheriff's Office, the County Attorney's Office and the Treasurer's Office against county administration have cost more than $2.5 million in legal fees according to the county's records through early November.

The Sheriff's Office has used attorneys from Ogletree, Deakins, Nash, Smoak and Stewart to wage legal battles with the county on issues including control of a law-enforcement computer system and the need to release surveillance footage of sheriff's deputies arresting Supervisor Don Stapley

in a county parking garage.

Next year, the Sheriff's office has asked for $7 million for this purpose.  Wow.  Given that I despise Sheriff Arpaio, I would love to lay this all at his door step but my sense is that the dysfunctionality goes broader and deeper.

Commuter Rail Numbers Don't Even Work With the Supporters' Numbers

From the AZ Republic, which just can't stop itself from shamelessly cheerleading any effort to spend billions on rail in Phoenix (perhaps the world's worst candidate for rail transit given its density and distribution of businesses).

Enough people would board a train in the Valley's suburbs that a future commuter-rail system would be as popular as some of the busiest lines in the West, new studies have found.

Well, that's a low bar.

A trio of yearlong rail studies, in nearly final form, indicates commuter rail could carry almost 18,000 passengers a day by 2030. Planners at the Maricopa Association of Governments

say, based on the findings, they favor a 105-mile, X-shaped system that could feature 33 stations and cost roughly $1.5 billion. That's a little more than the Valley's 20-mile, light-rail starter line.

If this was presented to me as a business opportunity, I would have had them stop right there.   Even before inevitable cost overruns and over-confidence in ridership, even with the supporters' numbers, they want $1.5 billion to carry 18,000 people a day.   That is a capital cost of $83,000+ per daily rider, beating the old record of Phoenix light rail which cost around $75,000 per daily rider.

Planners assume the trains will recoup about 40 percent of their expenses, based on the national average for similar service. The average fare would be about $6 to $7, Wallace said, although no detailed study has gone into fares. Generally, rates would go up the farther the trip.

Can you imagine any other investor in the world other than the government making an investment knowing that in the best case of its strongest supporters revenues will only cover 40% of costs?  And why should the rest of us subsidize folks who live in outlying areas to commute?  They moved to those areas in large part because housing was cheap and cost of living was low, with the knowlege they had a long commute.  So those of us with the forsight to live close to work have to subsidize them?  This is a really valuable service for them but they can't even pay half the cost?

Further, lets look at those cost estimates.  If we get 18,000 a day on weekdays and a third that on weekends, that yields 5 million round trips.  Given an 8% interest rate over 30 years, the capital charge is $134 million a year before overruns.  That means the fare would have to be $27 round trip or $13.50 one way just to cover the capital cost alone, without even considering operating costs.

This means their figures are nuts.  $6-$7 one-way fares barely covers 40% of the capital costs, much less the operating expenses.  We are talking about an offering that is deep in the red.  $13 round trip at 5,000,000 round trips equals $65,000,000 of revenue.  That means that taxpayers will have to foot the bill for all the operating costs  ($30 million?  $60 million) and at least $69 million of capital charges.   It is not unfair to assume that this would punch a minimum $100 million hole each year in the government's budget that we will have to make up with taxes.

Light rail is such a boondoggle. It's expensive to build and always runs at a loss. It is very hard to change the routes to respond to ridership needs. It's a vanity project for hip liberals.

If public transportation is a goal, then get some buses going. Buses are flexible, cost effective, cheap to run and maintain, and if ridership changes, you just change the routes and schedules.

WTF?

From the Arizona Republic:

Phoenix officials said Monday they remain confident Dubai is still a good place to do business, even after the Middle East emirate's investment arm announced it would not be able to pay creditors on time for some of its nearly $60 billion in debt.

"It's just a matter of when business will pick up again," said Community and Economic Development Director Don Maxwell, who has been bullish on the Middle East and Dubai, one of seven city-states that make up the United Arab Emirates. "You just don't know what the timing will be, but it will happen."

Seriously, why are we paying Phoenix government officials to opine on stuff like this, and why is it news?

The two cities have exchanged best practices for wastewater management. Dubai imported 80,000 Palo Verde trees from a Phoenix nursery. And Charity Charms, a Phoenix-based maker of charms for nonprofit groups, received a $13,000 order from a Dubai arthritis support group shortly after the agreement was inked.

Oh, I see now.  $13,000 in charms?  Dubai was practically driving our economy.

Wherein I Find Phoenix Is Not The Most Liveable City

Not Good

From CBS News, Via Matt Welch:

In a case that raises questions about online journalism and privacy rights, the U.S. Department of Justice sent a formal request to an independent news site ordering it to provide details of all reader visits on a certain day.

The grand jury subpoena also required the Philadelphia-based Indymedia.us Web site "not to disclose the existence of this request" unless authorized by the Justice Department, a gag order that presents an unusual quandary for any news organization...

The subpoena (PDF) from U.S. Attorney Tim Morrison in Indianapolis demanded "all IP traffic to and from www.indymedia.us" on June 25, 2008. It instructed Clair to "include IP addresses, times, and any other identifying information," including e-mail addresses, physical addresses, registered accounts, and Indymedia readers' Social Security Numbers, bank account numbers, credit card numbers, and so on.

This is remeniscent of the indimidation subpoena and later arrests at the Phoenix New Times orchestrated to stop the paper from criticizing Sheriff Joe Arpaio.

Charity - Not In My Backyard!

Via a reader, from the AZ Republic:

A Phoenix ordinance banning charity dining halls in residential neighborhoods withstood a challenge by a north-central Phoenix church.

Retired Arizona Supreme Court Justice Robert Corcoran, serving as a hearing officer, ruled Monday that feeding the homeless at a place of worship can be banned by city ordinance. The decision affects all Phoenix churches with underlying residential zoning.

Over the summer, city officials maintained that CrossRoads United Methodist Church, 7901 N. Central Ave., violated Phoenix zoning code by feeding the poor and homeless on its property, a use that can only occur in commercial or industrial zones.

You will be relieved to know that this has nothing to do with a wealthy people fearing that their Xanax-induced equilibrium will be upset by actually seeing a poor person in their neighborhood.   We are assured as such by Paul Barnes, a "neighborhood activist" who presumably participated in the suit to stop the Church from holding pancake prayer-breakfasts:

"It's not a problem with homeless people in wealthy neighborhoods. That would be a matter of prejudice. This issue would be setting churches up to avoid zoning ordinances."

Wow, I am so relieved.  And we all know what a problem it is when churches are organized solely to evade zoning regulations.  Why, just last week the First Baptist Church and Gas Station as well as the United Methodist Church and Topless Bar opened right in my neighborhood.

You will be happy to know as well that the Constitution in no way limits the government in any way when it wants to regulate your property:

In a 19-page opinion, [Judge] Corcoran said the city can restrict where the homeless and poor can be fed and that zoning regulations apply to everyone equally. Additionally, he said that trumping land-use regulations is not a constitutional right.

Whew - yet another assault on the rights of government bureaucrats has been bravely turned aside.

Remembering Mariano Rivera's Only Post-Season Blown Save

Rivera has 88 appearances in the post-season with only one blown save.  When he walks to the mound in the World Series, it is usually (in the immortal words of Bill Paxton) "game over man, game over."  But his one blown save is remembered in Phoenix, since it coincided with what is easily the greatest moment in Arizona pro sports history.

Because Minor Drug Cases Weren't Clogging the Courts Enough

The civil courts of Maricopa County (which includes Phoenix) are being overwhelmed by photo-radar cases from state photo-radar trucks on state highways.

In the 2008 fiscal year, ending June 2008, the total annual filings in the justice courts amounted to 435,014, which included DUI, traffic, misdemeanor and civil cases, according to the county. Since November 2008, speed-camera cases have flooded the justice courts, averaging 42,326 cases a month, accounting for 50 percent of the filings. Administrators for the justice courts expect the total might reach 600,000 this fiscal year.

Of course the solution proposed is not to get rid of the photo radar but to raise fees to cover the administration.  But you could have guessed that without me telling your, couldn't you?

Unexpected Problem - Finding Non Fluorescent White Paper

I am working on the first module in a new N-scale model railroad layout.  In this urban scene, I am using florescent paints of various types under black light to simulate neon and other lighting in night scenes.

I use printed paper in a lot of applications in my modeling - not just for business signs but highway signs, tar paper on roofs, some areas of brick and concrete, small details, etc.  The unexpected problem I am having is finding any white printer paper that doesn't fluoresce under black light (it is the whiteners that are used in modern papers that fluoresce -- in fact one test to see if you have an older document in your hand is to put it under black light).  Stop signs and tar paper roofs of buildings and manhole covers should NOT be glowing at night.

I am told some art supply stores sell non-fluorescent natural white papers, but I have yet to track any down.  I went into the OfficeMax yesterday with a handheld black light (we all own these in Phoenix for finding scorpions in our houses at night, as they fluoresce too, but that is another story).  The good news is that Homeland Security did not bust me for odd behavior, but I did not find anything that would work.  I actually have some clear paint that is a UV block, but it dries glossy, so right now I am painting a layer of the block and then a layer of matte clear coat.  This does not look entirely right, and is a pain to do for every item.

Light Rail Killing Another Transit System

I have written frequently that light rail tends to kill transit systems (Randal O-Toole has been a Cassandra on this subject for years).  Rail is so expensive to build and operate, and so inflexible in its routes and service structure, that once constructed it sucks resources from other modes (especially buses).   This leads to the counter-intuitive conclusion that these huge investments actually in the long run end up reducing transit system coverage and service and reducing ridership.  In particular, the poor, who depend on public transit as their lifeline rather than as a publicly subsidized alternative to buying a Prius, tend to get hammered.  Their bus service is cut and the light rail seldom runs where either their work or their homes are located.  Light rail is in effect a shifting of transit focus from serving the poor to serving the middle class (who wouldn't be caught dead on a yucky old bus but who like trains).

Enter Phoenix.  For the capital cost of $75,000 per daily rider, and large operating losses, we built ourselves a light rail line in one of the most dispersed cities in the country.  In other words, we spent $1.4 billion to serve a single 20 mile corridor which represented a tiny fraction of the city's commutes.  I predicted a while back two outcomes:

1) Light rail fares skyrocket to cover their immense operating deficits and capital costs, giving the lie to politicians that sold these systems as helping working poor.

2) Bus service, the form of transit that serves most of the working poor ...  is cut back to help pay for rail.

So, here is what I woke up to on the front page of our newspaper:

Phoenix's bus system, the largest in the Valley, may see a $16 million budget cut next year to avoid a deficit in 2012, transit officials say.

Bus-system officials will discuss the issue with the Citizens Transit Commission today.

The looming deficit is more bad news for bus riders. Cost-cutting in December and July reduced the frequency of some Phoenix routes and eliminated early morning and late-night service. Also, bus fares went up in all metro Phoenix cities and for Metro light rail this year.

Of course, as with all government analyses, the problem is not enough taxes:

Phoenix is going through multiple rounds of belt-tightening because sales-tax revenue, a crucial part of Phoenix's $171 million transit operating budget, continues to drop because of the economic downturn.

Transit 2000, the 0.4 percent sales tax that voters approved in March 2000, is bringing in less than projected. The tax was expected to generate $21.4 million during the first two months of this fiscal year. It brought in $14.3 million, said Lauri Wingenroth, assistant public-transit director.

Here is what they say don't say in the article, but should:  Most of the 2000 sales tax increase was allocated to the capital costs of light rail construction.  Those can't be cut back, because they are already sunk.  That means that most of these taxes are dedicated to paying off light rail bonds for the next 30 years, and those expenses exist no matter what they do.  So with no way to cut back on light rail expenses, buses (which have more variable costs than rail) are cut.  All exactly as predicted.

PS- Hilariously, right next to this article which should have been labeled a light rail fail, is an article about the "tragedy" that Phoenix is not on the Obama light rail boondoggle map.  Everyone else gets to waste a ton of federal money, why don't we have the same right?  If you read the article, you will find that a lot of countries that are orders of magnitude more dense and have much shorter inter-city travel distances than in the US are way ahead of us.  Left out of the article is the much higher percentage of freight that moves by rail rather than road in the US.

Phoenix police pump six rounds into the back of an innocent Phoenix homeowner who was still on the phone with 911 calling for their help with an intruder.

The scary part is how absolutely natural and well-polished the police's actions are in initiating a cover-up.  They may be screw-ups in the use of force, but they seem well-practiced in protecting their own from accountability.  Only the lucky break of having the 911 call still in progress and being recorded in the room the police were planning the cover-up prevented it from working.  Without this evidence, one wonders if the victim (who lived, incredibly) would have found himself accused of some heinous crime to take scrutiny away from the police.  "Oh, what's this here -- looks like a bag of white powder..."

One priceless detail is that the officer said he fired without seeing any gun in part because he thought he saw a Hispanic guy.  Wow -- if he loses his job with the Phoenix police (doubtful) I am sure Sheriff Joe would be thrilled to hire him.

We see this all the time nowadays - police roll without a thought into cover-up mode, and only the accident of video or audio recording prevents the cover up from working.  One wonders how many times they get away with this game when there is no electronic scrutiny.  Which is, I suppose, why police have invented a non-existent law that it is illegal to record their actions in public.  I am all for lojacking all of them with permanent electronic recorders.  (via Radley Balko, who has a roundup of a lot of similarly scary stories).

Postscript: The innocent homeowner (Tony) survived despite this treatment by police of his bullet-riddled body:

Officers ... painfully dragged Tony by his injured leg, through the home and out to his backyard patio, where they left him bloodied and shot right in front of [his family]."

The Arambulas say the officers later dragged Anthony onto gravel, then put him on top of the hot hood of a squad car, and "drove the squad car down the street with Tony lying on top, writhing in pain."

Phoenix Climate Change Presentation Email Link

Phoenix Climate Presentation, November 10 at 7PM

I have given a number of presentations on climate change around the country and have taken the skeptic side in a number of debates, but I have never done anything in my home city of Phoenix.

Therefore, I will be making a presentation in Phoenix on November 10 at 7PM in the auditorium of the Phoenix Country Day School, on 40th Street just north of Camelback.  Admission is free.  My presentation is about an hour and I will have an additional hour for questions, criticism, and rebuttals from the audience.

I will be posting more detail later, but the presentation will include background on global warming theory, a discussion of why climate models are likely exaggerating future warming, and an evaluation of various policy alternatives.  The presentation will be heavy on science and data, but is meant to be accessible without a science background.  I will post more details of the agenda as we get closer to the event.

Local Governments Mining for Dollars

As a small business owner, a huge portion of my time is spent feeding governments with all the paperwork they demand.  But this year has been twice as bad.  Every local authority we operate in has started mining for dollars.  What this has meant is a whole slew of property "reassessments" that have no basis in reality (e.g. values put on non-existent assets) that I have to spend a lot of my time fighting.  The general modus opperandi is to declare my company owes money for something fictitious, and then make us prove we don't.  Have you ever tried to prove you don't own an asset that doesn't exist?  Think about it.  How would you go about it, short of inviting the assessor out to your property to search for it.

Maricopa County, the county that includes Phoenix where my headquarters resides, has been the worst.  We buy assets for properties all over the country, and have the bill sent to our headquarters.  Often, if a registration is required, we will put our headquarters address on the government registration to make sure we get the renewal paperwork (long experience is that if anything gets sent out to an address in the field, it is lost).  The concept that an asset might be in location X but the paperwork should be sent to location Y is a really, really hard concept for a lot of state registration authorities to get their head around/

This year, Maricopa County has started sending us personal property tax notices for all kinds of assets that have never even existed in this county.  They were bought in state A, shipped to state B, with the bill sent to us here in Arizona.  But the County is in financial distress.  It probably understands that the asset does not exist in the County.  I am sure it knows that I don't, for example, have 24 cabins sitting on the fourth floor of this building, where they have them located.  But they need money.  If they send out enough fraudulent bills, and then tell taxpayers it is the taxpayer's responsibility to prove the bill is wrong, then they will likely get some money.   Yet again, the government is engaging in abusive practices that not private company could get away with for long.

I was pretty calm today on the phone with the assessor until this came up:

Me: Look, these are cabins I bought from a factory in Maricopa County but which were shipped immediately from the factory to California.

Assessor: I don't see where you filed for permission to move the cabins

Me: Excuse me?

Assessor: Your xxxyyy form [I forget the numbers].  You never filed for permission to relocate

WTF?  I know we have problems with declining tax roles, but do I really have to ask permission to move an asset out of the county or state.  What, did I violate directive 10-289?

So beware small businesses.  Your government is mining for dollars -- do not assume that tax bill is correct.
