We Love [Name of Government Project] As Long As Someone Else Bears the Cost

A reader sent me this, and I found it pretty funny:

Minnesota Public Radio and two neighboring churches in downtown St. Paul are escalating their opposition to the proposed line.

MPR said noise and vibrations from the train, connecting Minneapolis and St. Paul, could harm their ability to record and broadcast. The churches say those very same effects could rattle their aging buildings and disrupt their worship services.

In the latest salvo, MPR has asked the project planners to study alternative routes through downtown St. Paul.

MPR and the churches say they support light-rail, but not the proposed route along Cedar Street. The tracks would be laid about 14 feet from the front door of the broadcast center.

"As far as we know, this is the closest a light-rail line will run to federally designated noise- and vibration-sensitive facilities anywhere in the country," said Jeff Nelson, public-affairs director for MPR.

I am not sure a comment is even necessary.   MPR has published any number of light rail stories about budget and approval battles that were thinly disguised cheerleading for light rail.  Take this article for example, which discusses how light rail might be saved from trouble, but because it only quotes light rail supporters, a reader can't even figure out why the trouble exists.

Basically, MPR is saying "please put the rail line, which we support, near someone else who may hate it being nearby as much as we but don't have the access to the media and the political process to make a big stink about it."   Already, the line has apparently made an expensive accommodation for just one organization -- the University of Minnesota, a state agency.  The arrogance of this is staggering.  It reminds me of the NY Times and Columbia University, both of whom claim to be advocates for the underdog, except when the underdog gets in the way of their real estate deal and eminent domain grab.

By the way, am I the only one who has never heard of a federal designation for "noise- and vibration-sensitive facilities?"  If such a designation really exists (and I sure can't find it with any similar search terms on Google), what percentage of the list would you guess is politically connected organizations using the designation to get privileged treatment vs. those without power?

Update: The "federally designated" thing is a bit of an exaggeration.  The PR department of MPR was kind enough to send me a link.  They are referring to the category 1 designation in this report, which merely says that amphitheaters and recording studios should be in the quietest category when assessing impacts of transit nearby (neither MPR or any other facility is mentioned by name).  This same report essentially comes to the conclusion that it is perfectly possible for light rail to be near to recording studios and amphitheaters, just that some care needs to be taken in design.

By the way, the "As far as we know, this is the closes a light-rail line will run to" such a facility is just nuts.  I guess the "as far as we know" covers them from outright fraud, but I have to look no further than my own town of Phoenix to find light rail in proximity to such venues.   I know of a few radio stations and TV stations right on the rail line, but a quick Google maps search found at least 9 radio stations and TV stations and recording studios right on just the Central Avenue portion of the route.  In addition, I know of at least 5 ampitheaters on the route, not to mention our main public library.  (In fact, the library is right near the intersection of the rail line and Interstate-10, and I find it perfectly quiet there).  In fact, I would challenge MPR to identify one urban passenger rail line where there is NOT a radio station, TV station, recording studio, or ampitheater in close proximity.

Whatever Is The Most Important to You, We Are Cutting That First

The very essence of business decision-making is prioritization and trade-offs.  The same is true in the government, its just that the objective function is reversed:

GM is warming up the propaganda engine for the next run at Congress. "Look, the first thing we had to cut was our electric car program!".

And here I thought that because GM has still, after 30 years, failed to realize their business model needs to change that maybe management there were slow learners.  But they seem to be very, very adept at learning the government game.

When I was in the corporate world, if I wanted extra funds for my projects, I would have to go in and say "Here are all my projects.  I have ranked them from 1-30 from the most to least valuable.  Right now I have enough money for the first 12.  I would like funding for number 13.  Here is my case."

But the government works differently.  When your local government is out of money, and wants a tax increase, what do they threaten to cut?  In Seattle, it was always emergency services.  "Sorry, we are out of money, we have to shut down the fire department and ambulances."  I kid you not -- the city probably has a thirty person massage therapist licensing organization and they cut ambulances first.   In California it is the parks.   "Sorry, we are out of money.  To meet our budget, we are going to have to close down our 10 most popular parks that get the most visitation."  The essence of government budgeting brinkmanship is not to cut project 13 when you only have money for 12 projects, but to cut project #1.

I can just see me going to Chuck Knight at Emerson Electric and saying "Chuck, I don't have enough money.  If you don't give me more, we are going to have to cut the funds for the government-mandated frequency modification on our transmitters, which means we won't have any product to sell next month."  I would be out on my ass in five minutes.  It just floors me that this seems to keep working in the government.  Part of it is that the media is just so credulous when it comes to this kind of thing, in part because scare stories of cut services fit so well into their business model.

So of course, with billions of dollars of waste, absurdly high labor costs, stupid-large executive compensation, etc., GM chooses to cut funding the project that is most important to Congressional Democrats and the new Obama administration.

More Auto Bailout Thoughts

I don't think I have ever gotten as much mail from as many different readers as I have received on the auto bailout.  Readers seem fairly unified in their outrage and horror at the prospect.

Nancy Pelosi calls the deal a barber shop, where everybody will take a haircut.

There is already an available process for operating companies that cannot meet their obligations where all the parties take a haircut:  Its called chapter 11.  We have about a zillion man-years of experience with it, in companies great and small.  And it does not take idiotic Senators flashing billions of our tax money to mediate it.

The auto industry is tremendously magnetic for wannabee technocrats in Congress, in large part because in perhaps no other industry is there a bigger gap between what the average American wants to buy and what the country's intelligentsia things they should buy.

But US automakers are failing because they have not been very responsive to customers; they have grown fat and complacent, feeling protected by their monopoly power position; they have consistently failed over decades-long periods to make tough decisions vis-a-vis labor and costs; and they have refused to make real prioritization decisions (GM brand strategy is a good example).  It is therefore hilarious that Congress thinks it can do better, because wouldn't these same traits be high on the list of failings of the Federal Government itself?

And this is funny, if you have not seen it yet.

Perversity of Government-Selected Winners

Technocrats love to pick winners.  Leftish technocrats, in particular, love to believe that the complex operations of the entire economy choose technologies that are inferior to those the technocrat would have imposed on the economy had she been in charge.  But here is what happens when they try, in a cautionary tail that is particularly relevant given the number of specific technologies Barack Obama has said he would promote (e.g. a million plug-in hybrids by 2015) (via Tom Nelson)

The federal government has invested billions of dollars over the past 16 years, building a fleet of 112,000 alternative-fuel vehicles to serve as a model for a national movement away from fossil fuels.
But the costly effort to put more workers into vehicles powered by ethanol and other fuel alternatives has been fraught with problems, many of them caused by buying vehicles before fuel stations were in
place to support them, a Washington Post analysis of federal records shows.

"I call it the 'Field of Dreams' plan. If you buy them, they will come," said Wayne Corey, vehicle operations manager with the U.S. Postal Service. "It hasn't happened."

Under a mandate from Congress, federal agencies have gradually increased their fleets of alternative-fuel vehicles, a majority of them "flex-fuel," capable of running on either gasoline or ethanol-based E85 fuel. But many of the vehicles were sent to locations hundreds of miles from any alternative fueling sites, the analysis shows.

As a result, more than 92 percent of the fuel used in the government's alternative-fuel fleet continues to be standard gasoline. A 2005 law -- meant to align the vehicles with alternative-fuel stations -- now requires agencies to seek waivers when a vehicle is more than five miles or 15 minutes from an ethanol pump.

The latest generations of alternative vehicles have compounded the problem. Often, the vehicles come only with larger engines than the ones they replaced in the fleet. Consequently, the federal program --
known as EPAct -- has sometimes increased gasoline consumption and emission rates, the opposite of what was intended....

The Postal Service illustrates the problem. It estimates that its 37,000 newer alternative-fuel delivery vans, which can run on high-grade ethanol, consumed 1.5 million additional gallons of gasoline last fiscal year because of the larger engines.

The article does not even mention that E85 ethanol made mostly from corn does absolutely nothing to reduce total CO2 production (it just shifts it around, due to the amount of energy required to grow corn and convert it to ethanol) while raising food prices.

California did something like this years ago, putting the force of subsidies and state law behind zero-emission vehicles.  This wasted a lot of money on electric and hydrogen vehicles that were not yet technologically mature enough to prosper, while missing out on low (but now zero) emissions approaches that could have had much more impact because they were technologically ready (e.g. CNG for fleet vehicles).

Y'all know where I stand on the dangers of CO2.  But if we really have to do "something", then the only efficient way to do it is with a carbon tax.  But politicians hate this idea, because they don't want to be associated with a tax.  But the fact is, that every other action they are proposing is a tax of some sort too, but just hidden and likely less efficient.  There is no magic free lunch that Barack Obama and his folks can think of and impose, no matter how smart they are.  In fact, to some extent, smarts are a hindrance, because it tempts people into the hubris of thinking that they are smart enough to pick winners.

Postscript: If you are reading this and thinking "well, if I were in charge, I would not be that stupid and I could make it work" then you don't get it.  1)  No one can make it work, for the same reasons the Soviets could not plan their economy from the top -- its just too complex.  At best, policy-makers are choosing between a handful of alternatives to back.  In contrast, every individual has a slate of opportunities to reduce his/her CO2 production at the least cost, and when you add up all these individual portfolios, that means there are hundreds of millions of individual opportunities that must get prioritized.  That is what pricing signals do, but government bureaucrats cannot.  2) The morons and knaves ALWAYS take over.  Even if you are brilliant and well-motivated, your successor likely will not be. For years, folks have generally been comfortable with the outsized role of the Federal Reserve because they thought Greenspan  (and Volker before him) ran it brilliantly.  Well, there are arguments to be made about this, but even if we accept this judgment, what happens when the next guy is in charge and is not brilliant?

Postscript #2: If you want a specific example, let's take plug-in hybrids.  How can anyone be against these?  I personally like the concept of cars being driven by electric traction motors (I like the performance profile of them) and would love a good plug-in hybrid.  But what happens when we find out that many of these cars were bought in coal-burning areas where electricity is particularly cheap, and discover coal-fired electricity pollutes more than an internal combustion engine?  Or when we use a cap and trade system to cut back on coal fired plants, and find that the huge number of plug-in hybrids are exacerbating brown-outs and electricity shortages?  Or we find that the billions of dollars of capital diverted by the government to expanding plug-in hybrids could have easily yielded far more CO2 reduciton had it been applied in another area?  That is why a carbon tax is the only way to go (if we are going to do anything) because it allows individuals to make capital expenditure decisions to reduce CO2 based on their vastly higher knowlege of the opportunities and the pricing signal of the tax.

Government and Regulation

One argument about regulation that seems to be gaining traction through the recent financial crisis is "See, private action and enterprise is not infallible.  They can make mistakes that have costs for everyone.  Therefore they need to be regulated." 

I don't have time for the full refutation of this, but a few thoughts:

  • No one ever said that private actors in the economy are infallible or even universally honest.  However, no one has ever been able to make the case that government employees are any more infallible or honest. 
  • There are a couple of reasons government regulators are going to be demonstrably worse than the marketplace in making decisions.  The first is information -- a few actors in Washington can never have the same access to information as thousands of actors across the country or around the world.  The second is incentives -- while regulatory hawks cite private greed as a bad incentive in the marketplace, bureaucratic incentives can be at least as problematic.
  • Governments are subject to all sorts of rent-seeking initiatives, not to mention regulatory capture, that undermine regulatory effectiveness.  Just look at the bailout bill. Wooden arrows?

For some reason, the argument "private actors screwed up" seems sufficient justification for regulation.  The burden of proof should instead be "the government could have done better."

Here is a nice example of how regulation really works, from an interview with Warren Buffett:

QUICK: If you imagine where things will go with Fannie and Freddie, and
you think about the regulators, where were the regulators for what was
happening, and can something like this be prevented from happening
again?

Mr. BUFFETT: Well, it's really an incredible case study in regulationbecause
something called OFHEO was set up in 1992 by Congress, and the sole job
of OFHEO was to watch over Fannie and Freddie, someone to watch over
them. And they were there to evaluate the soundness and the accounting
and all of that. Two companies were all they had to regulate. OFHEO has
over 200 employees now. They have a budget now that's $65 million a
year, and all they have to do is look at two companies. I mean, you
know, I look at more than two companies.

QUICK: Mm-hmm.

Mr.
BUFFETT: And they sat there, made reports to the Congress, you can get
them on the Internet, every year. And, in fact, they reported to
Sarbanes and Oxley every year. And they went--wrote 100 page reports,
and they said, 'We've looked at these people and their standards are
fine and their directors are fine and everything was fine.' And then
all of a sudden you had two of the greatest accounting misstatements in
history. You had all kinds of management malfeasance, and it all came
out. And, of course, the classic thing was that after it all came out,
OFHEO wrote a 350--340 page report examining what went wrong, and they
blamed the management, they blamed the directors, they blamed the audit
committee. They didn't have a word in there about themselves, and
they're the ones that 200 people were going to work every day with just
two companies to think about. It just shows the problems of regulation.

The problem, of course, is that Fannie and Freddie were doing exactly what Congress wanted them to do -- systematically lowering mortgage underwriting standards.  They won't put it that way now, but that is  what spreading home ownership to lower income families really amounted to.

Local Papers and the Growth of Government

In some sort of synergistic relationship I haven't fully figured out, local newspapers love to cheerlead the expansion of government programs.  Here is a great example, via Rick Perry.  The headline in the Detroit Free Press web site reads:

State venture capital funds starting to pay off

But then we go on to read:

Michigan's two venture capital investment funds are starting to generate results, state economic  officials said Monday.

Since their formation in 2006, the $95-million Venture Michigan Fund
and the $109-million Michigan 21st Century Investment Fund have
invested in six venture capital firms with either a headquarters or an office
in the state. These firms have used the money and other capital to
invest in 11 fledgling Michigan companies that have added 40 workers in
recent years.

The two funds have made investment commitments of $116.3 million, or slightly more than half of their total capital.

So out of $204 million in taxpayer funds (why the state has entered the venture capital business with state funds is anybody's guess) the state has invested $116 million to create 40 jobs.  Given that the notion of the government venture fund was to create state jobs, its not clear how $3 million per job is a really good return.  Further, there is no mention of the government has gotten any kind of financial return from this investment, so I will presume it has not. So how can the paper possibly with a straight face say that the funds are "starting to pay off?" 

Eleven companies with an average of 3 employees each somehow each got $10 million in state funds.  I bet it would be fascinating to see just who these 11 companies are, and how their owners are connected into the political power structure. 

Now I Understand - Obama Means Five Million New Government Jobs

I have not been able to figure out how Obama gets to a 5 million job creation number from his alternative energy plans.  As I pointed out,

OK, so the total employment of all these industries that might be
related to an alternate energy effort is about 2.28 million.  So, to
add 5 million incremental jobs would require tripling the size of the
utility industry, tripling the size of the utility construction and
equipment industry, tripling the size of the auto industry, tripling
the size of the aircraft industry, and tripling the size of the
shipbuilding industry.  And even then we would be a bit short of
Obama's number.

But now I think I am starting to understand.  Tom Nelson gave me the clue with this article from the town of Frankfort, Kentucky:

Commissioners again discussed the possible creation of a sustainability coordinator position for the city.

Andy MacDonald, of the Mayor's Task Force on Energy Efficiency and
Climate Change, told commissioners that the creation of the position is
"the next critical step" to reduce the city's environmental footprint.

Commissioner Doug Howard brought up the possibility of asking the
city's recycling coordinator to fulfill part of the proposed position's
duties until money is available.

OK, so we need both a recycling coordinator and a sustainability coordinator for a town of 27,741 people (2000 census).  At this rate, that would imply nearly 22,000 government jobs across the country just in the government recylcing and sustainablity coordination field.  Now I am starting to understand.  Obama means five million new government jobs.

When Government Tries to Pick Winners

Folks like Barack Obama have decided that wind power is the answer.  They haven't studied the numbers or really done much to investigate the technology, and god forbid that they have put any of their own money into it or run a company trying to make thoughtful investment decisions.  But he's just sure that such alternative energy technologies work and make sense because, uh, he wants them to.

But when government picks winners, disaster almost always follows.  Oh, sure, the programs themselves get a lot of positive attention in the press, and people are happy to line up to accept subsidies and tax rebates.  But the result is often this:  (ht: Tom Nelson)

According to the Massachusetts Technology Collaborative, the agency
that oversees the state's major alternative energy rebate programs, the
small wind initiative was canceled because the turbines it has funded
are producing far less energy than originally estimated.

An MTC-sponsored study released earlier this summer found that the
average energy production of 19 small turbines reviewed was only 27
percent of what the installers had projected. The actual production for
the 19 turbines, which received nearly $600,000 in public funding,
ranged between 2 and 59 percent of the estimates.

A $75,663 turbine at Falmouth Academy that received $47,500 in state
money, for example, has produced only 17 percent of the projected
energy in the year since its installation. Another, smaller device in
Bourne is producing only 15 percent of the originally estimated energy.

So the state government funds 2/3 of the project and the project still doesn't make sense

Mr. Storrs criticized the state for dropping the rebate program, which
over two years has covered upward of half the cost of several turbines
on Cape Cod and dozens of others throughout the state, saying, "It is
not what you would hope a progressive [state] like Massachusetts would
cancel. You would hope that they are supporting alternative sources of
energy."

Actually, he is correct.  Sinking hundreds of thousands of dollars into faulty technology for terrible returns based solely on the fact that a certain technology is somehow politically correct is exactly what I too would expect of a progressive state like Massachusetts.

The state board complains that the technology choices and siting decisions were wrong.  Well, who would have imagined that investors in certain projects would be lax in their engineering and due diligence when the government was paying 2/3 of the freight, and when the main reason for the projects was likely PR rather than real returns?

If the bit about PR and political correctness seems exaggerated to you, check this out:

During the hearing on the proposal two months ago Mr. Storrs told the
planning board that the project was meant in part to help educate the
public about wind energy. Town Planner F. Thomas Fudala said it would
be informative to see whether the roof-mounted ones actually work.
"Even if this fails, it will be useful information," he said.

Mr. Storrs responded, "I know that sounds weird, Tom, but you are absolutely right."

Wow, I bet this kind of investment decision-making really give the local taxpayers a big warm fuzzy feeling.  By the way, this article also includes an example of why Al Gore and others proposing 10-year crash programs to change out the entire US power infrastructure are impossibly unrealistic, even forgetting about the cost:

Mr. Storrs said he first ordered
the Swift brand turbines last year as part of a bulk order along with
the Christy's gas station in West Yarmouth.

But the planning board had already adopted its new turbine regulation,
which, in part on the advice on Ms. Amsler, had prohibited the
roof-mounted machines.

"The town was just trying to be responsible in terms of looking out for
its residents, trying to make sure these things are not going to pop up
everywhere if they aren't going to work," said Thomas Mayo, the town's
alternative energy specialist.

At Mr. Storrs request, however, the planning board then went back and
reconsidered its regulation. After a public hearing featuring testimony
from Ms. Amsler as well as from a representative of Community Wind
Power who argued that the Swift turbines work well and as advertised,
the planning board decided to change the bylaw and allow Mashpee
Commons to move forward with its project.

The Mashpee bylaw requires a return on investment plan, a maintenance
plan, as well as proof that the proposal meets several safety and
aesthetic prerequisites.

Town Meeting adopted the new bylaw in May, Mashpee Commons quickly
filed its application, and received a special permit in early June.
During the comment period for the special permit, the state program was
suspended.

After receiving the special permit, Mr. Storrs said he applied for
Federal Aviation Administration approval, which is required for any
structure over three stories in town. More than two months later, he
said he is still awaiting that approval.

Mr. Mayo said the town's application for FAA approval of a site under
consideration for a large municipal turbine took six months to approve.

Great Moments In Government Spending: The Station to Nowhere

Mayor Daley of Chicago has a great idea:  despite already having rail transit service between O'Hare Airport and Downtown, he wants to build a new non-stop express rail line to save travelers about 9 minutes.  After all, if Moscow just did this, it must be a good idea.

OK, this is dumb enough.  But what is really amazing is that Chicago embarked on building a $320 million downtown station for the project without even a plan for the rest of the line -- no design, no route, no land acquisition, no appropriation, no cost estimate, nothing.  There are currently tracks running near the station to the airport, but there are no passing sidings on these tracks, making it impossible for express and local trains to share the same track.  The express service idea would either require an extensive rebuilding of the entire current line using signaling and switching technologies that may not (according to Daley himself) even exist, or it requires an entirely new line cut through some of the densest urban environments in the country.  Even this critical decision on basic approach was not made before they started construction on the station, and in fact still has not been made.

Though the article does not mention it, this strikes me as a typical commuter rail strategy -- make some kind of toe-in-the-water investment on a less-than-critical-mass part of the system, and then use that as leverage with voters to approve funding so that the original investment will not be orphaned.  Its a kind of blackmail that both makes me sick, and is necessary for these systems as voters would never ever approve the kind of money that would be required to build the whole project  (If this express line requires $320 million just for one station on one end of the line, can you imagine the total cost?  $10 billion? for 9 minutes time savings).

More Great Moments in Government Spending

Apparently, 3-1/2 miles of new border wall near San Diego will cost at least $57 million, or $16.3 million a mile (or a bit over $3000 per foot).  For comparison, the 350 mile long Maginot line cost France about $150 million in the 1930s, or about $2.3 Billion in today's dollars.  This puts the cost of the Maginot line, underground tunnels, bunkers, gun emplacements, and all, at $6.5 million current dollars per mile.  Of course, the Maginot line was not built as a continuous wall to catch individual infiltrators, but on the other hand the San Diego wall is (presumably) not being built  30 kilometers deep with layered emplacements to handle massed tank and artillery attacks.

It could be worse for taxpayers - they could be laying railroad track instead of building a wall, since that costs about $96 million per mile here in Phoenix.

I can't wait for those huge administration cost savings that are promised from nationalizing health care.

Update: I just thought of one other comparison- like the Maginot line, at least one end of this San Diego wall hangs in the air, meaning it just ends hundreds of miles before the border does, allowing it to be easily flanked.

Dumbest Thing I Have Read Today

Apparently from the lips of Barack Obama, via the WSJ and Tom Nelson:

"I want you to think about this," Barack Obama said in Las Vegas last
week. "The oil companies have already been given 68 million acres of
federal land, both onshore and offshore, to drill. They're allowed to
drill it, and yet they haven't touched it "“ 68 million acres that have
the potential to nearly double America's total oil production."

Wow.  I would not have thought it possible to blame government restrictions on drilling, which the oil companies have decried for years, on the oil companies themselves.  But apparently its possible. 

1.  Just because the Federal Government auctions an oil lease, it does not mean that there is oil there.  And if there is oil there, it does not mean the oil is recoverable economically or with current technology.  Does this even need to be said?

2.  The implication is that oil companies are intentionally not drilling available reserves (to raise prices or because they are just generally evil or whatever).  But if this is the case, then what is the problem with issuing new leases?  If oil companies aren't going to drill them, then the government gets a bunch of extra leasing money without any potential environmental issues.  Of course, nobody on the planet would argue Obama's real concern is that the new leases won't get drilled -- his concern is that they will get drilled and his environmental backers will get mad at him.

Dumbest Thing I Have Read Today

Apparently from the lips of Barack Obama, via the WSJ and Tom Nelson:

"I want you to think about this," Barack Obama said in Las Vegas last
week. "The oil companies have already been given 68 million acres of

Government Schools

I thought this was a very illuminating bit from Obama on education:

TAPPER: But"¦proponents of school choice say that the best way to
change the status quo is to give parents, inner-city parents a choice.
Why not?

OBAMA: Well, the problem is, is that, you know, although it might
benefit some kids at the top, what you're going to do is leave a lot of
kids at the bottom. We don't have enough slots for every child to go
into a parochial school or a private school. And what you would see is
a huge drain of resources out of the public schools.

So what I've said is let's foster competition within the public
school system. Let's make sure that charter schools are up and running.
Let's make sure that kids who are in failing schools, in local school
districts, have an option to go to schools that are doing well.

But what I don't want to do is to see a diminished commitment to the
public schools to the point where all we have are the hardest-to-teach
kids with the least involved parents with the most disabilities in the
public schools. That's going to make things worse, and we're going to
lose the commitment to public schools that I think have been so
important to building this country.

Some responses:

  • I love it when my opponents make my argument for me.  One strong argument for school choice is that public schools put a governor on 80% of the kids' educations, forcing them to learn at the pace of the slowest students.  But Obama basically says this.  He acknowledges in paragraph three that most of the kids would take the private option (and the only reason they would do so is that they perceive it to be better) leaving only the "hardest-to-teach
    kids with the least involved parents with the most disabilities in the
    public schools."  I'm sorry Mrs. Smith, I know you want more for your kids, but we've decided that they should not have a better education than that demanded by the least involved parents.
  • If his fear in  paragraph #3 comes true, isn't that consistent with a leftish market failure model?  And if so, why wouldn't it be entirely appropriate for the government to focus only on this small segment not served by private schools?  Isn't that what the government does in, say, housing or transportation, providing services only to a small percentage of the market?
  • Obama parrots the "there are not enough private schools" objection.  Duh.  Of course there is not currently 20 million student-slots of excess private school capacity just waiting for school choice.  But capacity will increase over time if school choice is in place.  Or, if the capacity does not appear, then what's the problem for Obama?  Everyone will just stay in government schools.
  • The class warfare here is both tiresome and misplaced.  Most school voucher plans have explicitly focused on the poorest families and worst schools as a starting point
  • The statement that kids leaving public schools with vouchers would be costly is just wrong, at least from a monetary point of view.  I don't know of any voucher program where students are offered a voucher as large as the average per-pupil spending of that school district.  So, in fact, each student leaving public schools is a new financial gain, subtracting a $6,000 voucher but removing at the same time an $8,000 cost.
  • Finally, note the political mastery here.  Take the question of how many kids would leave government schools for private schools under a full school competition system.  Obama wants to be on both sides of this assumption, sometimes assuming the number is small (when discussing benefits) and then assuming the number is large (when discussing costs).  Obama is a master because he makes this switch back and forth from sentence to sentence.  First, the  number leaving public schools is low, since choice would just benefit "some kids" (Bad old rich ones at that) and leave our "a lot of kids."  He again in the next sentence implies the number switching must be low, because there are not many private school spots.  One sentence later, though, the number switching is high, since it would be a "huge drain of resources."  And then, in the third paragraph, the number switching is very high, since all that are left in public schools are a small core of the "hardest-to-teach kids."

Also note what was strategically left out of his answer:

  • "Even if school choice worked, I could never support it because my party depends too much on the teachers unions in this election."
  • "Just when I have a good chance to be the leader of this government, do you really think I want to abandon the government monopoly on the indoctrination of children and the power that brings to the government?"

How Mussolini-Style Fascism Almost Came to the US

First, it was the National Recovery Act, where FDR explicitly tried to creat an economic system modelled on Mussolini-style fascism.  This was killed by the Supreme Court.  But the will of government to create an economic system where private companies win and lose based on how well connected they are to politicians never goes away.  The lastest attempt to set up such a managed system was via the Lieberman-Warner climate bill:

But perhaps even more pernicious is the way that "carbon credits" are distributed.

The credits are best described as a pulled-out-of-thin-air government-created fiat currency,
that is accepted only by the government in exchange for the
government's permission to let you emit CO2. (If ever a system was perfectly set up to be abused and politicized by politicians, this is it.)

Government bureaucrats will decide
sector by sector and industry by industry which companies get the
credits. Implicitly, that same decision by government regulators also
determines which companies will need to buy credits from the politically-connected companies who could get their carbon credits for free.

Prices vs. Government Action

Very often on this blog I criticize some ill-conceived government intervention as being bloated and/or ineffective and ill-conceived.  A great example is corn-ethanol, where the government has spent billions and caused consumers to spend additional billions in higher food and gas prices, all for a technology that does nothing to reduce oil consumption or CO2 output.

Too often, I criticize these programs for being stupid and ill-conceived, which they are.  But what I don't take the time to also point out is the necessarily narrow focus of these government actions.  No matter how hard Congress works to stuff energy and farm bills with every micro-managing pork barrel project their campaign donors could wish for, Congress still only has the bandwidth to affect a tiny fraction of a percent of what a single change in market prices can achieve.  Prices have absolutely stunning power of communication.  When gas prices go up, every single citizen likely reassesses his/her behavior and spending in a myriad of ways.  Thousands of entrepreneurs sit at their desk staring at the walls, trying to dream up business opportunities that these new prices may signal.  And thousands of energy producers, from the tiniest to the largest, rethink their investment plans and priorities. 

Government Licensing Is To Protect Businesses from Competition

Part number whatever in a series.  Today's danger to consumers and the Republic is:  people offering to drive others around without a license.

A man who said he thought he was just helping a woman in need is accused of running an illegal taxi service.  Miami-Dade
County's Consumer Services Department has slapped Rosco O'Neil with
$2,000 worth of fines, but O'Neil claims he is falsely accused.....

The 78-year-old said he was walking into a Winn-Dixie to get some
groceries when he was approached by a woman who said she needed a ride.

"She asked me, 'Do I do a service?'" O'Neil said.

"I told her no. She said, 'I need help getting home.'

"O'Neil told the woman if she was still there when he finished his shopping, he would give her a ride. She was, so he did.

As
it turned out, the woman was an undercover employee with the consumer
services department targeting people providing illegal taxi services.

"She
said the reason she targeted him (is because) she saw him sitting in
his car for a few minutes," said Ellen Novodeletsky, O'Neil's attorney.

After
O'Neil dropped off the woman, police surrounded him, issued him two
citations and impounded his minivan. On top of the fees, it cost O'Neil
an additional $400 to retrieve his minivan from the impound lot.

There are no prior complaints that O'Neil was providing illegal transportation for a fee.

I don't care if he was running a business or being a good Samaritan -- I see no possible reason that this type of transaction should be illegal.

While We Are On The Subject of Oil...

Glen Reynolds brings us this:

A provision in the US Carbon Neutral Government Act incorporated
into the Energy Independence and Security Act of 2007 act effectively
bars the US government from buying fuels that have greater life-cycle
emissions than fuels produced from conventional petroleum sources.

The United States has defined Alberta oilsands as unconventional
because the bitumen mined from the ground requires upgrading and
refining as opposed to the traditional crude pumped from oil wells.

California Democrat Representative Henry Waxman, chairman of the
House Committee on Oversight and Government Reform and Republican Tom
Davis added the clause.

Uh, right.  Since we all burn pure unrefined crude oil pumped right from the oil well in our car. 

Here is what a traditional crude oil goes through before it becomes gasoline:

  • Water and salt must be removed
  • The oil is heated up to over 700 degrees, and is separated into its fractions via distillation.  Oil is made up of hydrocarbon chains of many lengths, from short ones (methane, ethane, propane) to very long ones (asphalt, heavy motor oils).  Gasoline is somewhere in between.
  • Each fraction generally has to be de-sulfurized.  This generally occurs by injecting hydrogen into the fraction across a catalyst bed to remove the sulfur as Hydrogen Sulfide, a dangerous gas that must be further processed to produce pure sulfur.
  • The gasoline fractions in a typical oil are nowhere near large enough for the relative demand.  So additional steps must be taken to produce gasoline:
    • Very heavy fractions have their molecules cracked at high temperatures, either in cokers, high temperature crackers or in fluid catalyst bed crackers.  These processes either remove carbon in its pure form or remove it by combining it with hydrogen
    • Certain fractions are reformed in combination with hyrdrogen, sometimes across a platinum catalyst, to produce molecules with better properties for gasoline, including higher octane.
    • All over a refinery, there are small units that take individual fractions that use a variety of processes to create specific molecules that have useful properties
  • All of these different fractions and products are blended in various proportions to make different grades of gasoline.  These blends and proportions can change from city to city (to meet environmental regulations, Phoenix must have a gasoline blend that is unique in the US) and must change season to season (gas that burns well in winter will vapor lock in the summer time).

I am sure I left tons of steps out, but you get the idea.  Below are my old digs at Exxon's Baytown Texas Refinery, where I worked as an engineer for 3 years out of college:

Two-Income "Trap", aka the Government Trap

Todd Zywicki has a nice post on the The Two-Income Trap: Why Middle Class Mothers and Fathers are Going Broke by Professor Elizabeth Warren and Amelia Warren Tyagi. 

In his writings on the tactics for engineering the communist state, Karl Marx talked a lot about the need to "proletarianize the middle class."  This has been a very popular tactic among leftish writers and politicians today, attempting to convince the middle class that they never had it so bad.

I won't repeat Zywicki's whole post, but the books author's argument revolve around examples which purport to show that as families go from one to two earners, their costs (health care, child care, cars, mortgage, etc.) go up by more than the additional income, making them poorer on a discretionary spending basis.

Zywicki first points out the same thing I immediately thought of when I read a summary of the book:

It is not clear what to make of all of this, except that it is hard to
see how this confirms the central hypothesis of "The Two-Income Trap"
that "necessary" expenses such as mortgage, car payments, and health
insurance are the primary draing on the modern family's budget. And
again, this unrealistically assumes that all increased spending on
houses and cars is exogenously determined, ignoring the possibility
that an increase in income leads to an endogenous decision by some
households to increase their expenditures on items such as houses and
cars.

While the assumption seems crazy, it makes sense in the context of leftish ideology, which holds that the middle class have only limited free will and tend to have their decision making corrupted by advertising and other corporate pressures.

But Zywicki goes further, and actually digs into the author's numbers.  He finds that the authors are surprisingly coy about addressing changes in taxation in their numbers.   Zywicki then uses the authors' own numbers, this time with taxes factored in using the authors' own assumptions, and gets these two charts:

As Zywicki summarizes:

As can readily be seen, expenses for health insurance, mortgage, and automobile, have actually declined
as a percentage of the household budget. Child care is a new expense.
But even this new expenditure is about a quarter less than the increase
in taxes. Moreover, unlike new taxes and the child care expenses
incurred to pay them, increases in the cost of housing and automobiles
are offset by increases in the value of real and personal property as
household assets that are acquired in exchange.

Overall, the typical family in the 2000s pays substantially
more in taxes than in their mortgage, automobile expenses, and health
insurance costs combined.
And the growth in the tax obligation
between the two periods is substantially greater the growth in
mortgage, automobile expenses, and health insurance costs combined. And
note, this is using the data taken directly from Warren and Tiyagi's
book.

Government-Think in Marion County, Florida

I just encountered an absolutely classic bit of government think.  Here is the background.

In Florida, on each night stay in the campgrounds we run in Marion County, we collect a 6% state sales tax, a 0.5% county sales tax, and a 2% tourist development tax, for a total of 8.5%.  Until this month, we reported and paid all three taxes to the state of Florida on one simple return.  The state then divvied the money up to the counties.  Apparently, this latter process could take up to 90 days before the County got their tourist development money.

The County commissioners of Marion County did not like waiting 90 days for their tourist development money.  Remember, this is not general revenue money, but supposedly trust fund money that must be spent on tourist advertising and the like.  Also, recognize that 90 days for a government body to disperse money is pretty normal - I find I often have to wait as long as 6 months to get a check out of the feds.

Anyway, the County wanted its money faster.  So it decided to collect the money itself.  First this involved more staff hours and designing a new online collection system, costs that are completely incremental because the state of Florida was performing these functions before (and still are performing them).  Today, it now requires two systems and clerical staffs to collect money that was once required by just one. 

Already, this seems like idiocy to any business person.  Is adding a whole new staff and systems really worth getting money 90 days faster?  I guess it is possible, but even if one could argue this point, we now get to the real government-think.  Because there is no way anyone in whatever cost-benefit trade-off they ran considered the time and effort that would be required of individual taxpayers.  Even in my small company, this will now require extra clerical labor each month as well as an initial system reprogramming to add the extra tax authority.  If one considers thousands of other businesses in the exact same position, the amount of investment is enormous.

But in my experience, when running cost-benefit trade-offs, the government never, ever considers investment and time required of the citizens who must comply.  I have seen governments make changes designed to save a few man-hours a month in their own clerical departments that cause thousands or millions of man-hours of extra work among taxpayers.   A year or two ago, Mono County, California forced us to go from one to twelve reports each month for our lodging tax payments just to save auditors a few hours work every three years.   And do you know why?  Because the government treats us all as serfs.  As far as they are concerned, our labor is free, because they have the power to compel us to do whatever they ask without compensation.

Postscript:  Here is my other Florida county tax collector pet peave.  All the tax collectors in Florida put their own personal name all over everything.  Their web site is not "marion county tax collector"  but "George Albright, Marion County Tax Collector." Their stationary has this man's name all over it.  When I right a check to them, I am supposed to include this man's name.  I hate this kind of public employee self-aggrandizement.  It is a blatant use of taxpayer money to try to aid one's next election chances, and it is a waste of money when a new person comes in office because every piece of printed material must be thrown out and reprinted.  This seems to be fairly unique to Florida.  Look at the Marion County links for other states in the same search and you don't see the same thing going on in those states.

Senior Government Official Using His Position to Presure Textbook Publishers

The US Government requires that garage door openers include an electric eye system that prevents the door from closing if the beam is broken.  Unfortunately, given dirty garages, it is really easy for this beam to be blocked by dust and such.  Two years ago, the beam system caused my door to go back up without my knowledge (I just hit the button and went inside) and as a result our garage was robbed that night. 

This time of year is especially frustrating for us.  My garage faces south, so the low sun this time of year overwhelms the electric eye system in most garage doors and causes them to refuse to close.  It is hugely frustrating, and a real security issue.  I glued tubes around each eye to try to shade the sun, but it is still working erratically.  I spent much of last weekend trying to figure out how to bypass the system electrically but I could not make it work.  Finally, I have had enough.  I have spent ten times the cost of the garage door opener in stolen goods and my personal time fighting this stupid device.  Tonight I am going to remove the two eyes and just mount them facing each other on a wall so I don't have to worry about them any more.  Unless someone can come up with a better solution. 

In my mind this is a classic example of government technocracy -- someone decided for us that we should value a minuscule increase in safety over a substantial reduction in security.

Can't Anyone Solve Problems Without the Government?

Here is today's lament in the Arizona Republic:

Government plans to more than double the size of Petrified Forest
National Park appear to be in jeopardy because Congress has failed to
come up with the cash to buy surrounding properties.

The upshot: An irreplaceable treasure of dinosaur bones and Indian
ruins may be lost as ranchers sell off their properties for subdivision
and development.

And Petrified Forest is not alone. A study to be released April 8 by
the non-profit National Parks Conservation Association, says 56 federal
historic and recreation sites "could lose
land inside their borders to developers this year." Others on the list
range from Gettysburg National Military Park near Philadelphia to
Golden Gate National Recreation Area in San Francisco.

Here is an idea:  All you folks who are worried about these "treasures" can pool your money and buy the properties yourselves.  That way you can either take charge of the preservations or donate the land to the government to do so.  This is how many public parks came into being in the first place, from private donations.

Of course, this was back in the days when environmental groups actually spent their money on the environment.  Today, they spend their money instead on lobbying.  The more modern approach is not to spend your own money on the environment, but to lobby the government to force other people to spend their money on the environment.  That is why people have apparently donated $300 million dollars (!) to Al Gore to create an advertising campaign dedicated to trying to spur government action on CO2.  Rather than donating money to help solve the problem, people now donate money to push for government coercion.

Besides representing the modern approach to environmentalism  (ie don't work the problem, just lobby the government to force other people to work the problem), Gore's campaign also represents a new frontier in rent-seeking.  He has managed to get people to donate $300 million dollars to advocate government action that will likely have very little actual impact on the climate, but may have a huge impact on Al Gore's managed $5 billion investment fund.  Congrats, Al.  Even the kings of rent-seeking at ADM would not have had the cojones to ask folks to donate to a charitable advertising fund to support their subsidy requests.

 

Another Government Program that Misses the Point

Apparently, the state of Arizona, fearing the coming old-folks demographic boom, is looking to create programs to keep older Americans working longer (and by extension off the government teat longer).

The thought of millions of boomers taking their early-retirement
benefits is causing concern about the stability of Social Security and
Medicare.

"We know not everybody is going to up and retire all at once," Starns
said, "and we will have younger workers coming in. But if you look at
all the demographics, there just won't be enough people to fill all the
jobs that could be vacant."

Add that possibility to existing shortages of workers in health-care
and other fields, she said, and "there could be some pretty significant
problems in society."

Arizona, which launched its Mature Workforce Initiative in 2005 to
avert such a crisis, was one of five states lauded last month for
efforts to engage people 50 and older in meaningful jobs and community
service.

The San Francisco-based Civic Ventures think tank also cited
California, Maryland, New York and Massachusetts, saying the five
states recognize older workers as "an experience dividend," rather than
a drain on resources.

Of course, since it is government, the state of Arizona is, with one hand, patting itself on the back for instituting vague and meaningless but well publicized programs nominally targeted at this issue, while with the other taking steps that have real and substantial effects in exactly the opposite direction.

First, Arizona has some of the toughest laws in the country to penalize businesses for hiring, even accidentally, young vigorous immigrants who don't have all their government licenses in order.   Young workers are pouring into this state every day, but Arizona is turning them away and locking them up. 

Second, Arizona has been legislating as fast as it can to make it nearly impossible to hire older workers.  I know, because the vast majority of my work force managing campgrounds is over 65.  These workers tend to work for a free camp site plus minimum wage.  They like the job despite the low pay because they get a place to park their RV and because the job is part time and very flexible in how they work (not to mention offers the opportunity to take whole chunks of the year off).  I like these workers because they are experienced and reliable and paying them minimum wage helps offset their slowing productivity and higher workers comp costs as they age. 

Here is the math:  Older workers might work 30-50% slower than a younger worker (I have workers right now in their nineties!)  They also have higher workers comp costs, maybe equating to as much as 10% of wages.  This means that an older worker at the old minimum wage of $5.15 an hour might be financially equivalent to a younger worker making $9.50 an hour, which is about what we might have to pay for such a worker. 

However, many states have implemented higher minimum wages with annual cost of living escalators.  States like Oregon and Washington now have minimum wages over $9.00.  At $9.00 an hour, an older worker is now financially equivalent to a younger worker making $16.50 an hour, well above what I can hire such a person for.  This means that as minimum wages rise, I have to consider substituting  younger workers for older but slower workers.

Last year, Arizona adopted just such a minimum wage system with annual escalators.  Though we have not reached the point yet, the state soon may make it impossible economically to hire older workers.  Already, we are looking at some automation projects to reduce headcount in certain places.  This is sad to me, but in a business where a 12% rise in wages wipes out my entire profit, I have to think about these steps.  I have to react to the fact that, no matter how many "policy advisers on aging" the state hires, in reality it is increasing the price to my company of older people's labor vis a vis younger workers.

Flaws with the Constitution

From the Arizona Republic:

Three day laborers filed a lawsuit Tuesday that seeks to overturn a
suburb's law prohibiting people standing on public streets from
soliciting employment from occupants of cars.

The federal lawsuit alleges Cave Creek's law passed is unconstitutional
because it restricts the free speech rights of people trying to find
work as day laborers.

"Cave Creek does not have the right to pick and choose who has free
speech rights," said Monica Ramirez, an attorney for the American Civil
Liberties Union, one of the group's representing the day laborers. "The
town cannot bar people from peaceably standing in public areas and
expressing their availability to work."

The stated reason for the law is this, but don't believe it:

Mayor Vincent Francia said the law was a response to concerns raised by
residents over traffic being impeded by people congregating on street
corners.

If you followed the genesis of this law, it has less than zero to do with traffic.  It was crafted as a way to prevent people of Mexican birth, with or without the proper papers from the US government, from seeking work in Cave Creek.  Which explains why sheriff Joe Arpaio is so eager to help enforce the law, and why, by some statistical fluke, everyone arrested under the law seems to be of Mexican Latin descent  (the three laborers filing the suit are Mexican and Guatemalan and are in this country legally).

I am happy to see this suit get filed under whatever auspices that it can, and have in the past supported using the first amendment to protect free commerce.  Further, I am thrilled to see the ACLU, given its Stalinist origins, for once actively support the right to publicly advertise and conduct commerce.  However, it is sad to me that Thomas Jefferson and company did not think it necesary to enshrine the right to free commerce as an protected right up there with speech and association.

One might argue that the enumerated power concept and the 9th amendment should be protection enough, but obviously Jefferson did not think so or he would not have pushed for the Bill of Rights.   And saying the following may just prove that I am not a Constitutional expert, but it strikes me that another problem with the original Constitution that probably wasn't fixable at the time was the fact that the Bill of Rights did not originally restrain the states, only the Federal government.  Only with the beat-down of states rights concepts in the Civil War and the passage and later interpretation of the 14th amendment did the Supreme Court begin to apply the Bill of Rights to states and municipalities as well.  It is good that they have done so, but these protections enforced on states only tend to be the enumerated protections of the Bill of Rights.  In fact, in this context, the 9th is meaningless because it reserves unenumerated powers to the people or the states, so it contributes nothing to reigning in municipalities, only the Feds. 

All that being said, it should would have been nice to have three extra words such as "or conduct commerce" inserted after assembly:

Congress shall make no law respecting an establishment of
religion, or prohibiting the free exercise thereof; or abridging the
freedom of speech, or of the press; or the right of the people
peaceably to assemble [or conduct commerce], and to petition the Government for a redress of
grievances.

 

Bear Stearns Roundup

My friend Scott, who actually worked for Bear Stearns years ago, sent me one of the more down to earth explanations of a liquidity trap that I have heard of late.  Imagine that you had a mortgage on your house for 50% of its current value.  Then suppose that in this alternate mortgage world, you had to renew your mortgage every week.  Most of the time, you are fine -- you still have good income and solid underlying asset values, so you get renewed with a rubber stamp.  But suppose something happens - say 9/11.  What happens if your renewal comes up on 9/12?  It is very likely that in the chaos and uncertainty of such a time, you might have trouble getting renewed.  Your income is still fine, and your asset values are fine, but you just can't get anyone to renew your loan, because they are not renewing anyone's loan until they figure out what the hell is going on in the world.

Clearly there are some very bad assets lurking on company books, as companies are still coming to terms with just how lax mortgage lending had become.  But in this context, one can argue that JP Morgan got a screaming deal, particularly with the US Government bending over and cover most of the riskiest assets.  Sigh, yet another government bailout of an institution "too big to fail."  Just once I would like to test the "too big to fail" proposition.   Why can't all those bankers take 100% losses like Enron investors or Arthur Anderson partners.  Are they really too big to fail or too politically connected to fail?

Update:  I don't want to imply that everyone gets off without cost here.  The Bear Stearns investors have taken a nearly total loss - $2 a share represents a price more than 98% below where it was a year or two ago.    What I don't understand is that having bought Bear's equity for essentially zero, why an additional $30 billion guarantee was needed from the government.
