Error: Circular Reference

Les Miles will remain as coach of the LSU football team (at least for a while) despite being wooed by Michigan.  (LSU must wonder what's wrong with their coaching job - they have won two national championships this decade but can't get a coach to stay).

In order to keep Les Miles, LSU inserted this clause in his contract:

Should Miles win the BCS championship [ed:  which he now has accomplished] his contract states he has to be
among the top three paid college coaches in the nation, which would
bump him to the $3.5 million range.

This is not uncommon language now in sports contracts.  For example, players with a franchise tag in the NFL must get a salary equal to or greater than the average of the top five players at that position.

So here is my question.  What happens if three other college coaches, say Pete Carrol, Jim Tressel, and Urban Meyer (who have all won national championships in the last 10 years) were to demand that they too should be guaranteed a salary that puts them in the top three coaches?  Don't things start getting real recursive at this point?

Postscript:
Yeah, I know, the language generally says they get bumped to a top X position on the day of a certain event, like winning the BCS or having the franchise tag applied, which circumvents the circularity problem, mostly, by not being an open-ended reset.   It is still funny to think about.   There is nothing to stop 4 coaches from negotiating a clause with an open-ended reset such that their salaries would spiral to infinity.  Even Solomon might struggle with that one when it went to court, though the Gordian Knot solution would be to just run one of the four through with a sword.

I wonder if this has ever happened, say with two CEO's that had contracts that guaranteed that each would, at any given time, be the highest paid CEO in the Fortune 500.

Licensing Update

Awesome!  Via TJIC:

Ten minutes after finding out I passed the Bar, I changed my
long-running position on licensure, which it turns out is awesome. Not
only does it allow me to collect above market rents"“which lawyers need
because law school is so damned expensive"“but it also keeps those who
can't afford law school or Barbri from practicing law. This is good
because poor people make bad choices anyway, and I know that because
one week in college I ate Ramen noodles for a week, and that's the week
I decided to major in music. Also your average poor person, usually
cursed with some manner of hump or undeveloped siamese twin, will not
fit into a decent suit"¦

In sum, remember when choosing a lawyer that I was the first
one to finish the New York Bar exam, and though I probably didn't get
the highest score, I got the not-highest score the fastest. So if
you've got the choice between an attorney who will show up at 7 AM
sharp, with an obviously freshly dry-cleaned suit, and me, who will be
jogging fifteen minutes behind him while pulling on a shirt and
cleaning up some stubble with an electric razor, remember: the other
guy's smarter, of course, but I'm still competent. And a lot better
rested. Plus I'm not going to judge you for running that red light and
hitting that old lady"“that's what this case is about, right? Or was
that my other client?"“because chances are I nailed two or three myself
on the way over this morning.

Music Recommendations

A while back, I solicited input on what bands a lover of classic rock should be listening to from the last 10 years.  I got about 40 responses.  Here are some of the more popular recommendations:

First, several people suggested Pandora.com, an internet radio station that will play music based on songs or bands you like.  I have used Pandora for a while and really like it.  I have found a number of albums I really love from this source.  For example:  Frank Zappa's "Shut up and play yer guitar" series of live guitar solos.   RadioParadise.com also had a number of supporters, and I am running it right now as I type.  It streams a fairly eclectic mix of old and new music.

Several bands / albums got multiple votes.  Those included:

Clutch
Corrosion of Conformity
Dream Theater
Queens of the Stone Age
Tool

I will try a selection and let folks know. 

Lot's of support for the most recent Rush efforts, which I already own and enjoy.  Ditto Stone Temple Pilots and the Black Crowes, though I am not sure their best work quite clears the 10-year-old hurdle.  Someone suggested Days of the New -- I own their first album and really enjoy it (acoustic grunge?).  I also own and enjoy both "Burning for Buddy" CDs that several folks recommended, if you are looking for something jazzier.

None of this will allow you to claim you have current musical tastes.

Among current rock bands that I know of, I like the White Stripes.  But
that's about all I know.

Soundgarden / Metallica / Nirvana / Pearl Jam sort of represent the new end of my music collection, beyond which I am attempting to fill in the white space.

When an Ivy League Degree is a Handicap

Megan McArdle writes:

Why is it so much fun to hate Ivy Leaguers? In part, because they
(well, we*) can often be so hateable. For years, I toyed with the idea
of offering a prize to the first Harvard grad I met who did not, in the
first ten minutes of conversation, manage to work that fact into the
conversation somehow.

OK, I have a couple of Ivy League degrees, so now I have fallen into the trap as well.  But I say that mainly to tell a story about running a small business.

Running a service business that is dispersed across many locations in 12 states, I cannot personally be on top of everything.  Not even close.  I depend on my employees taking the initiative to tell me when they think the company should be doing something differently or better.  However, many of my employees do not have college degrees at all.  This is not a problem for their job performance, as most have a lot of life experience and they do their jobs quite well.  Unfortunately, if or when they find out I have a Harvard B-School degree, the very likely outcome is that they stop making suggestions.  They make the assumption that because I have a more expensive piece of paper on my wall than they do, that I must know what I am doing.  They are embarrassed to try to give me suggestions.  Which is a crock.

I constantly have to hammer home two messages to my employees, both of which are hard to get people to believe despite the fact that they are true:

  1. Most of my employees do their job better than I would do their job.  They tend to assume they are somehow an imperfect proxy for me, when in fact, because their skills and interests are different, they usually do what they do better than if I focused on the same job myself
  2. If the company is doing something stupid, it is probably not because I want it that way.  It is probably because I am ignorant, either of the problem or of the better way to do it. 

How Princeton Uses Its Money

Everybody is always trying to spend someone else's money.  This kind of thing would really make me sick, except it is a little funny to see the kind of class warfare and redistributionist economics preached by elite universities come back to bite them:

Dr. Gravelle points out that endowment wealth is concentrated in the
upper ranks, much of it at 62 institutions with endowments larger than
$1 billion. But just three years ago only 39 schools had billion-plus
endowments. That's a 38% increase in just a few years. In 2006, 125
schools had endowments over $500 million"”a third more than in 2002. The
number of schools that can count themselves as endowment-rich or
super-rich is growing rapidly....

What the data shows is that endowment wealth is everywhere"”except in
the hands of the students who need it today. Last year endowments
increased 17.7% on average"”those larger than a billion increased 18.4%.
Yet, despite double-digit increases stretching back a decade or more
"”endowment spending is at a nearly all-time low of 4.2%--down from 5.1%
in 1994, 6.5% in 1982, and 5.2% in 1975....

Tuition has been going up so rapidly for so long it has reached nearly
ungraspable levels. So let me put today's tuition cost in concrete
terms. Senators, what would your constituents say if gasoline cost
$9.15 a gallon? Or if the price of milk was over $15? That is how much
those items would cost if their price had gone up at the same rate that
tuition has since 1980.

I believe that skyrocketing tuition is
undoubtedly the biggest "access" problem in higher education. What can
possibly be more discouraging to a capable student whose parents are
not wealthy than a school with a $45,000 price tag on the door?...

Congress should not hesitate to consider a minimum payout
requirement"”and 5% should be considered a starting point. The 5% number
is a dated one"”even for private foundations. Many schools have been
rolling over so much money for so long that they should easily be able
to accommodate a higher rate of payout. Possibly the most significant
challenge for policymakers will be to make sure that any newly directed
monies actually go toward aid or tuition reduction and don't become
part of a shell game.

Seriously, is there no pocket of private money that socialists won't stick their hand into?  In effect, at the same time Americans get lambasted for saving too little, this guy is going after private universities for saving too much?  And note the implicit assumption about government intervention he holds and expects all of Congress to hold in the third paragraph above:  It is just assumed that if prices go up enough to upset the constituents, then it is Congress's job to act.

Far be it for facts to get in the way of good populism, but I do know what Princeton does with its 2nd or 3rd largest endowment:

  • Every student who gets admitted gets a financial aid package from the University that will allow them to attend, no matter what their finances are.  Yes, the student may have to work his butt off, but if he really wants to go to Princeton he will be able to go.  Princeton's wealth also allows it to be much more friendly in these financial assessments.  For example, many assets like the parent's house are taken off the table when assessing ability to pay
  • If a student graduates normally, then all of her debts are paid off at graduation.  Every student graduates debt-free, giving them far more flexibility in what jobs they choose our of college.  No longer must they eschew non-profit or low-paying jobs due to the burden of debt.
  • Princeton has accepted that applying more money to increasing the educational intensity of its existing 4000 students by an additional 0.1% is not the best use of its investment.  It has committed (in too small of a way for my preferences, but that is another matter) to using its fortunes to increase its size and bring Ivy League education to more people.  This year, it increased its entry class size by 250, which may seem small to those of you from large universities but is about a 20% increase for Princeton.

Since all Princeton students get whatever aid they need and graduate debt-free.  So the tuition number is irrelevent.  And statements like "I believe that skyrocketing tuition is
undoubtedly the biggest "access" problem in higher education" are virtually meaningless. 

Simply Outrageous

Via Cato@liberty, comes this really outrageous incident:

The Gilpin County Sheriff's Office was
apologizing Monday after a weekend effort to help a research group led
to complaints about what appeared to be a DUI checkpoint - but wasn't....

Sgt.
Bob Enney said deputies assisted the Pacific Institute for Research and
Evaluation in stopping motorists at five sites along Colorado 119 for
surveys on any drug and alcohol use. Surveyors then asked the motorists
to voluntarily submit to tests of their breath, blood and saliva. At
least 200 drivers were tested, Enney said....

They were greeted by "youthful, college" surveyors dressed in jumpsuits and blue generic caps.

      

"We
had a 10-year-old in the back who's tired, we tell them thanks but no
thanks, we have to get this child back home to bed," Sequeira said.

He said a worker persisted, saying that the researchers would assist in driving the family home if they needed assistance.

      

When the Sequeiras again demurred, a supervisor offered them a $100 money order.

      

"We
say, 'No, thank you, we have to get our child home,"' Sequeira
recalled. "At this point, both clones start chortling at us and
ridiculing us."

The problem in this case is that many people don't take the time to even take a 5-minute survey over the phone, much less to pull over on the roadside and donate bodily fluids.  Every market researcher understands this problem, and tries to deal with it.  But the government has one tool in its bag that ordinary private firms do not have:  The coercive power of the government.  Whether they were tested or not, motorists who were in complete obedience to the law were forced to pull over by government law enforcement officials merely to increase their survey response rate.  This is such a typical government solution that I think most people are desensitized to it.

Ask a Question, Get an Answer

A while back, I wondered if the highest paid public employee of every state was a university men's football or basketball coach.  Well, its not exactly answering the same question, but via the Sports Economist comes this article that head coaches beat the governors 49-1 in the salary sweepstakes.  Only the Alaska governor makes more money than the state university head coaches (probably because there is no college football in Alaska).  Governors probably have more job security, though.

Unlike my question, the author considers coaches at any college, public or private.  For example, my readers found that NY is probably an exception -- there are public employees paid higher than public university coaches.  This article comes to the opposite conclusion, but only because they use Syracuse University, which is a private institution.

...Or, You Could Choose Your College This Way

Last week, I pointed out that my alma mater Princeton had again topped the USN&WR college rankings.  But those college rankings were for those who wanted to invest their tuition money and four years of their life at the school that would, you know, educate them the best. 

If, however, you would rather choose a college based on how well it serves everyone else's interests rather than your own, you can use this ranking from Washington Monthly, presumably chosen with help from special correspondent Ellsworth Toohey.  Universities are chosen for social contribution and research and number of Peace Corps volunteers and the like.  No indicators of educational quality or student satisfaction are used.  Really, they don't seem to be joking:

U.S. News & World Report publishes its university rankings
every year, and every year people complain about them. So starting in
2005 we decided to do more than just complain, and instead came out
with our own rankings "” based not on reputation or endowment size, but
rather on how much of a contribution each university actually makes to
the country.

Top universities on the list presumably teach important skills like:

  • How to find a job that helps lots of people but doesn't pay very much and provides no job satisfaction
  • How to find a boyfriend who beats you a lot and never can hold a job, but needs your financial support really badly
  • How to invest in companies with no prospects but who need the money very much (taught presumably by Eugene Lawson)

In this list, a Peace Corps volunteer is ranked to have made a larger contribution to America than say:  Jimmy Stewart, Meg Whitman, Jeff Bezos,  James Madison,  etc.  (Oh, and Pete Conrad, probably my personal favorite Princeton Grad, and first man on the moon after Neil Armstrong's dress rehearsal on a Hollywood soundstage with Buzz Aldrin and OJ Simpson.)

This is maybe a great list if you have a billion dollars burning a hole in your pocket and want to find a university to endow, but of what utility is this for prospective students?

Postscript: You do, though, have to give Washington Monthly props for putting Texas A&M at the top of their list, a university whose student body is probably least likely of almost any major state school to purchase very many copies of their magazine  [a comment on their political orientation, not their ability to read].

The Most Important College Football Poll of the Year

The most important college football poll of the year is out, and the top five are as follows  (rank, team, #1 votes record so far, total points):

Many of you might notice that all of these teams have a record of 0-0.  So you might ask, "Coyote, are you crazy, why did you call this the most important poll of the year?"  Well, since I answered that last year, I will go back a year ago and quote myself:

In theory, voters in the college football polls each week come up
with their current ranking of teams, which in theory could be very
different from how they ranked things the previous week.  In practice,
however, voters start with their rankings of the previous week and then
make adjustments up and down for individual teams based on that week's
game results....

In effect, the college football rankings are a bit like a tennis ladder. Each
week, losers drop down 3-8 spots and all the winners and no-plays move up to
fill in the vacated spots. Sometimes a team will leapfrog another, but that is
rare and it is extremely rare to leapfrog more than 1 or 2 spots. In this sense, the
initial football poll is the most critical, since only those in the top 10-15
have any chance of moving up the ladder to #1.

In
effect, the pre-season poll is the baseline off which all future polls
start.  I haven't done the research, but you could probably refine my
statement in the previous paragraph to a set of rules such as:

  • A three-loss team can never win the championship
  • A two-loss team can win but only if they start in the top 5 of the pre-season poll
  • A one-loss team can win but only if they start in the top 15
  • An undefeated team can win even if they were left out of the
    initial top 25, but only if they play in a major conference.  A minor
    conference team, even undefeated, will not ever end up #1 unless they
    started the season in the top 25.

Again, the numbers in these rules may not be exactly right, but I
think they are directionally correct.  This is what I call my theory of
College Football Calvinism (the religion, not the cartoon character)
since one's ultimate fate is in large part pre-ordained by the polls
even before the season is born.  So, if your alma mater has any shot at
the title, you should hope your AD is out there in the summer lobbying
the writers like hell to up their pre-season poll standings. Every spot
you gain in the pre-season poll is one you don't have to win on the
playing field.

The Silicon Valley of Begging

Stephen Dubner's roundtable on the Economics of Street Charity got me thinking about a recent experience visiting Boulder, Colorado, an odd but lovely town in which I used to live.

Here in Phoenix, most of our panhandlers show little or no innovation.  They are still using the "will work for food" or "Vietnam vet" cardboard signs that were an innovation years ago, but now are tired and hard to believe.  All the signs were generic.  None of them seemed tailored to the local audience. 

So where is the innovation in begging occurring?  Someone must have first thought of the "will work for food" come-on which I presume was so initially successful, since everyone copied it, just as they copy any successful innovation in the marketplace?

My vote for the Silicon Valley of Begging is Boulder, Colorado, and specifically on the Pearl Street Mall.  I have recently visited homeless capital Santa Monica, and San Francisco, as well as New York and Boston, and none of their beggers hold a candle to those in Boulder.  Here is why:

  • Their come-ons were unique -- I never saw the same one twice
  • Their come-ons were well tailored to the local audience.  "Need Money for Pot" is not going to get one anywhere in Oklahoma, but it is very likely to elicit a chuckle and a buck from a UC college student or sixties-survivor Boulder resident.  Given that President Bush has about a 0.01% approval rating in Boulder, many of the come-ons led one to believe that giving the beggar a buck would show one's disdain for GWB.

The Highest Paid Public Employees

Phil Miller observes that the new Hawkeye football coach is now the highest-paid government employee in Iowa.  This is wildly unsurprising.  In fact, I renew my question that we never got a final answer on:  Is there any state in which a college athletics coach is NOT the highest paid public employee in the state?

with their counterparts in the other 49 states and the District of

New York: Alain Kaloyeros, vice president and chief administrative
officer at the College of Nanoscale science and Engineering and an
expert in the field of nanotechnology, became the highest paid employee
after the State University of New York (SUNY) chancellor approved a
$142,000 per year raise, bringing his annual salary to $666,995, the
Associated Press reports. (

However, based on football coaches in Texas alone (most of whom
make more than $1 mil), none of these other employees come close (just
as you predicted).  Even college basketball coaches are making alot of
money now.  In fact, before A&M's Gillespie bolted to Kentucky, he

And for the record, I think the coaches that get a cut of ticket
revenues are in a conflict of interest, due to the fact that more than
90% of Div I schools fund athletics departments through student fees (

and their sport typically get a large amount of promotion through
by the institution.  Then again, the entire collegiate enterprise is
backwards to begin with...

College Kids: Suck it Up

Of late, it certainly appears that many colleges have invented a new right:  The right not be be offended.  Many college speech codes still are alive and well, and the broadest of them ban any speech that any particular listener "finds offensive"  (this example at Brandeis University carries especially sweet irony).  As I have written a zillion times, bans on hate speech are usually the leading edge of attempts to apply fairly comprehensive speech controls.

So Kudos to MIddlebury's President Ronald D. Liebowitz, as quoted at FIRE, who makes what should be an obvious point, that there is no crime in speech that makes you uncomfortable.  Speech one disagrees with needs to be answered with more speech.

But greater diversity means change, and change on college campuses
is almost always difficult. Few 18 to 22 year olds are skilled in
inviting or tolerating perspectives that are vastly different from than
their own. Frankly, the same goes for 30-, 40-, and
50-something-year-old academics. Even though a campus may become more
diverse in terms of the numbers of underrepresented groups present, the
level of engagement can still be inconsequential if those representing
different viewpoints are not encouraged and supported to express them.
If an institution is not prepared to make space, figuratively speaking,
for previously excluded groups, and support their presence on campus,
its diversity efforts cannot succeed. And if the wariness about
discomfort is stronger than the desire to hear different viewpoints
because engaging difference is uncomfortable, then the quest for
diversity is hollow no matter what the demographic statistics on a
campus reflect.
 
In order for the pursuit of diversity to be intellectually
defensible and valuable to those seeking a first-rate education at
places like Middlebury, it needs to result in deliberation. It cannot
simply facilitate the exchange of one orthodoxy or point of view for
another. The best liberal arts education requires all voices, those of
the old order as much as those of the new, and even those in between,
to be subjected to the critical analysis that is supposed to make the
academy a distinctive institution in society.

The American Dream

I am still underwater here completing a few projects, but Brink Lindsey is blogging on the most recent study claiming that income growth and the American Dream are somehow dead for the average American. 

Seriously folks, if I had a betting market that would allow you to bet on either income mobility in the US or in France, which would you take?  Seriously?  Given that the US has higher economic growth, orders of magnitude lower barriers to entrepreneurship, and no history of bright-line class distinctions that carry down through history, as France does, where would you bet?

Well, actually, there is such a betting market, and it is called immigration.  Guess which way it is running for the most talented people for whom income mobility would pay the greatest benefits?  Have you heard the stories of the brilliant young technology minds moving from the US to France to start their new business?  Yeah, neither have I.

And don't make the mistake that "Oh, this is fine for smart college educated kids, but how about for poor people?"  Congress is currently tying itself into knots over the problem of about 12 million poorer people for whom America was such an economic attraction that they were willing to break the law to come here.  Which, coincidently, also goes a long way to explaining why US median income always seems stagnant in studies over the last 30 years.  It is because tens of millions of poor immigrants have come in at the bottom, bringing down the mean and median at the same time most individuals are climbing.  It is for this reason that the average individual can be doing better and better at the same time the mean is flat or even going down.

Postscript:  I was emailing back and forth with Brink and he made a great point, which you should look for him to embellish on his blog tomorrow, which I would summarize this way -- No number of dollars in 1970 would buy a laptop computer
loaded with a real-time strategy game that you can play with 64 of your
friends over the Internet or on which you could store a few thousands CD-quality (CD, what's a CD?) songs.

Introducing Obama to Capitalism

Via TJIC:

In his commencement speech at Southern New Hampshire University
this morning, Obama - like most commencement speakers - delivered a
call to public service; unlike many, however, he also warned against
the charms of doing what most college graduates set out to do: Make
money.

"In a few minutes, you can take your diploma, walk off this
stage and go chasing after the big house and the large salary and the
nice suits and all the other things that our money culture says you
should buy.

"But I hope you don't. Focusing your life solely on making a
buck shows a poverty of ambition. It asks too little of yourself. And
it will leave you unfulfilled," he told the crowd.

This statement would certainly be true in 18th century European monarchies, in Soviet Russia, in third world Kleptocracies, in Cuba, and in Chavez's Venezuela.  Because making money in these environments is a zero-sum game, and the only way to get rich is to loot it from some poor schmuck who is actually creating the value.

But here in America, we (mostly) have this cool system called capitalism.  In capitalism, all interactions are based on the voluntary self-interest of the parties involved.  This means that one only can "make a buck" by doing something or making something that is of value to another person.  And only by successfully serving the needs of a LOT of people does one get really rich. 

TJIC's conclusion is wonderful:

Far better that they spend their life

  • majoring in political "science"
  • working for a meaningless non-profit
  • trying to register more people to vote so that the negative-sum game of politics can have more credibility
  • helping political partisans redrawn electoral district boundaries in the same negative-sum game of politics
  • being a senator, pushing for more regulations and tax increases

That, clearly, is a fulfilling life.

Let the suckers create value.

The best and brightest should just steal it, and move it around
(while taking some portion of it for themselves, and destroying another
portion of it).

Beware of people who try to demonstrate how much they "care" using other peoples' money.

Free Speech and Immigration

Frequent readers of this blog will know that I am a strong supporter of open immigration, and have substantial problems with how we are effectively criminalizing poor people looking for work. 

However, it is perhaps most important to defend the free speech of people with whom one disagrees.  A while back, my employee accidentally sent a private email from his private account expressing opinions about stronger defense of the border and enforcement of immigration laws (opinions that run counter to my own) to a government employee with whom we interact fairly frequently.  The government employee's first impulse was to threaten that our company may be liable under anti-discrimination laws for such speech, but to their credit quickly agreed that it was inappropriate for a federal employee to take any action based on private speech.  But that first, initial reaction was interesting.

It seems a professor here in the Phoenix area is facing sanction for similar reasons.

The case involves Walter Kehowski, a math professor at Glendale
Community College"”part of the Maricopa County Community College
District (MCCCD) system"”who e-mailed a single Thanksgiving message to
the entire MCCCD community. On the day before Thanksgiving, Kehowski
sent an e-mail
containing the text of George Washington's "Thanksgiving Day
Proclamation of 1789" over the district's "announcements" listserv.
Kehowski had found the Proclamation on Pat Buchanan's blog, and included a link to that webpage in his e-mail. That citation would have dire consequences.
 
Within weeks, five MCCCD employees complained that Kehowski's
e-mail was "derogatory" and "hostile" because the link he'd included"”if
you decided to open it"”led to a page where Buchanan also posted his
opinions of immigration. MCCCD soon held an Initial Assessment
of the complaints, and decided that since Kehowski's e-mail was not
work-related but rather expressed a "social comment," he had violated
MCCCD's e-mail policies, which limit e-mails to work-related
information. MCCCD reacted on March 9 by forcing Kehowski to cease
teaching, placing him on immediate administrative leave, and
recommending that he be terminated....

MCCCD has also found Kehowski guilty of violating the Equal Employment Opportunity policy.

Again we have government sanctioning speech based on its content, a definite no no, particularly since there was a pretty clear precedent for other people using the email system ant that particular listserv to pass on social commentary without sanction.  Its clear, though, that many in the college's community found the speech somehow in violation of discrimination laws.

However, this is the irony I find amazing:  State, Federal, and Maricopa County law require that businesses discriminate against undocumented aliens.  I can be fined and sent to jail for not discriminating against them.  Maricopa county, which runs this particular community college, employs a sheriff that revels in anti-immigrant rhetoric that probably runs more extreme than even Pat Buchanan and who prides himself on how many illegal immigrants he has rounded up this week (he.  In this context, how can it be illegal to advocate for enforcement of current law?  How can it be illegal to advocate for policies aggressively pursued by your own employer? 

Any viewpoint in speech needs to be tolerated, but I find it especially odd that government institutions are unable to tolerate speech that upholds what is essentially the official position of the government.

Moratorium on Brains

For years, socialists (and some sloppy capitalists) have operated under the assumption that production only requires labor and capital.  Socialists assume that if a government steals both, it can produce just as well as any of those greedy private companies.  Hugo Chavez has been operating under this assumption, but he has run into a problem:

The companies ceding control included BP Plc,
ConocoPhillips, Exxon Mobil Corp, Chevron Corp, France's Total SA and
Norway's Statoil ASA. All but ConocoPhillips signed agreements last
week agreeing in principle to state control, and ConocoPhillips said
Tuesday that it too was cooperating.

While the state takeover was planned well ahead of time, the oil
companies remain locked in a behind-the-scenes struggle with the
government.

Chavez says the state is taking a minimum 60 per cent stake in the
Orinoco operations, but he is urging foreign companies to stay and help
develop the fields.

They have until June 26 to negotiate the terms.

The companies have leverage with Chavez because experts agree that
Venezuela's state oil company, Petroleos de Venezuela SA, cannot
transform the Orinoco's tar-like crude into marketable oil without
their investment and experience.

In other words, beyond their workers and plant and equipment, he needs their brains.  And I hope the American companies refuse to give in to him.

I made this point earlier in this critique of socialism:

arguing about whether brute labor, as socialism teaches, is the source
of all wealth (which, socialism further argues, is in turn stolen by
the capitalist masters).  The young woman, as were most people her age,
was taught mainly by the socialists who dominate college academia
nowadays.  I was trying to find a way to connect with her, to get her
to question her assumptions, but was struggling because she really had
not been taught many of the fundamental building blocks of either
philosophy or economics, but rather a mish-mash of politically correct
points of view that seem to substitute nowadays for both....

I
picked up a handful of sand, and said "this is almost pure silicon,
virtually identical to what powers a computer.  Take as much labor as
you want, and build me a computer with it -- the only limitation is you
can only have true manual laborers - no engineers or managers or other
capitalist lackeys"....

She
replied that my request was BS, that it took a lot of money to build an
electronics plant, and her group of laborers didn't have any and
bankers would never lend them any....

I
told her - assume for our discussion that I have tons of money, and I
will give you and your laborers as much as you need.  The only
restriction I put on it is that you may only buy raw materials - steel,
land, silicon - in their crudest forms.  It is up to you to assemble
these raw materials, with your laborers, to build the factory and make
me my computer.

She thought for a few seconds, and responded "but I can't - I don't know how.  I need someone to tell me how to do it"

And
that is the heart of socialism's failure.  For the true source of
wealth is not brute labor, or even what you might call brute capital,
but the mind.  The mind creates new technologies, new products, new
business models, new productivity enhancements, in short, everything
that creates wealth.  Labor or capital without a mind behind it is
useless.

Wealth Creation and the Zero-Sum Fallacy

This is an update of an article I post every year or two around tax day.  I was going to skip this year, but tomorrow is the premiere of a show (which I have not seen yet) called the Ultimate Resource which seems to be named after Julian Simon's great book, and looks to be focused on many of the same issues I address in this post.

One of the worst ideas that affect public policy around the world is that wealth is somehow zero sum - that it can be stolen or taken or moved or looted but not created.  G8 protesters who claim that poor nations are poor because wealthy nations have made them that way;  the NY Times, which for years has flogged the idea that the fact of the rich getting richer in this country somehow is a threat to the rest of us; Paul Krugman, who fears that economic advances in China will make the US poorer:  All of these positions rest on the notion that wealth is fixed, so that increases in one area must be accompanied by decreases in others.  Mercantilism, Marxism, protectionism, and many other destructive -isms have all rested on zero-sum economic thinking.

The (Incorrect) Physics Analogy

My guess is that this zero-sum thinking comes from our training and intuition about the physical world.  As we all learned back in high school, nature generally works in zero sums.  For example, in any bounded environment, no matter what goes on inside (short of nuclear fission) mass and energy are both conserved, as outlined by the first law of thermodynamics. Energy may change form, like the potential energy from chemical bonds in gasoline being converted to heat and work via combustion, but its
all still there somewhere.

In fact, given the second law of thermodynamics, the only change that will occur is that elements will end in a more disorganized, less useful form than when they started.  This notion of entropic decay also has a strong effect on economic thinking, as you will hear many of the same zero sum economics folks using the language of decay on human society.  Take folks like Paul Ehrlich (please).  All of their work is about decay:  Pollution getting worse, raw materials getting scarce, prices going up, economies crashing. They see human society driven by entropic decline.

Wealth Is Demonstrably Not Zero-Sum

So are they wrong?  Are economics and society driven by something similar to the first and second laws of thermodynamics?  I will answer this in a couple of ways.

First, lets ask the related question:  Is wealth zero sum and is society, or at least the material portions of society, always in decline?  The answer is so obviously no to both that it is hard to believe that these concepts are still believed by anyone, much less by a large number of people.  However, since so many people do cling to these false notions, we will spend a moment or two with it.

The following analysis relies on data gathered by Julian Simon and Stephen Moore in Its Getting Better all the Time:  100 Greatest Trends of the Last 100 Years. In fact, there is probably little in this post that Julian Simon has not said more articulately, but if all we bloggers waited for a new and fresh idea before we blogged, well, there would not be much blogging going on.

Lets compare the life of an average American in 1900 and today.  On every dimension you can think of, we all are orders of magnitude wealthier today (by wealth, I mean the term broadly.  I mean not just cash, like Scrooge McDuck's big vault, but also lifespan, healthiness, leisure time, quality of life, etc).

  • Life expectancy has increase from 47 to 77 years
  • Infant mortality rates have fallen from one in ten to one in 150.
  • Average income - in real dollars - has risen from $4,748 to $32,444

In 1900, the average person started their working life at 13, worked 10 hours a day, six days a week with no real vacation right up to the day they died in their mid-forties.  Today, the average person works 8 hours a day for five days a week and gets 2-3 weeks of vacation.  They work from the age of 18, and sometimes start work as late as 25, and typically take at least 10 years of retirement before they die.

But what about the poor?  Well, the poor are certainly wealthier today than the poor were in 1900.  But in many ways, the poor are wealthier even than the "robber barons" of the 19th century:  Just check out this comparison!  Today, even people below the poverty line have a good chance to live past 70.  99% of those below the poverty line in the US have electricity, running water, flush toilets, and a refrigerator.  95% have a TV, 88% have a phone, 71% have a car, and 70%have air conditioning.  Cornelius Vanderbilt had none of these, and his children only got running water and electricity later in life.

To anticipate the zero-summer's response, I presume they would argue that the US somehow did this by "exploiting" other countries.  Its hard to imagine the mechanism for this, especially since the US did not have a colonial empire like France or Britain, and in fact the US net gave away more wealth to other nations in the last century (in the form of outright grants as well as money and lives spent in their defense) than every other nation on earth combined.  I won't go into the detailed proof here, but you can do the same analysis we did for the US for every country in the world:  Virtually no one has gotten worse, and 99.9% of the people of the world are at least as wealthy (again in the broad sense) or wealthier than in 1900.  Yes, some have slipped in relative terms vs. the richest nations, but everyone is up on an absolute basis.

The (Correct) Physics Analogy

Which leads to the obvious conclusion, that I shouldn't have had to take so much time to prove:  The world, as a whole and in most of its individual parts, is wealthier than in was in 1900.  Vastly more wealthy.  Which I recognize can be disturbing to our intuition honed on the physical world.  I mean, where did the wealth come from?  Out of thin air?  How can that be?

Interestingly, in the 19th century, scientists faced a similar problem in the physical world in dating the age of the Earth. There was evidence all around them (from fossils, rocks, etc) that the earth had to be hundreds of millions, perhaps billions of years old. The processes of evolution Darwin described had to occur over untold millions of years.  Yet no one could accept an age over a few million for the solar system, because they couldn't figure out what could fuel the Sun for longer than that.  Every calculation they made showed that by any form of combustion they understood, the sun would burn out in, at most, a few tens of millions of years.  If the sun and earth was so old, where was all that energy coming from?  Out of thin air?

It was Einstein that solved the problem.  E=mc2 meant that there were new processes (e.g. fusion) where very tiny amounts of mass were converted to unreasonably large amounts of energy.  Amounts of energy so large that it tends to defy human intuition.  Here was an enormous, really huge source of potential energy that no one before even suspected.

The Human Mind Has Huge Potential Energy

Which gets me back to wealth.  To balance the wealth equation, there must be a huge reservoir out there of potential energy, or I guess you would call it potential wealth.  This source is the human mind.  All wealth flows from the human mind, and that source of energy is also unreasonably large, much larger than most people imagine.

But you might say - that can't be right.  What about gold, that's wealth isn't it, and it just comes out of the ground.  Yes, it comes out of the ground, but how?  And where?   If you have ever traveled around the western US, say in Colorado, you will have seen certain hills covered in old mines.  It has always fascinated me, how those hills riddled with shafts looked, to me, exactly the same as the 20 other hills around it that were untouched.  How did miners know to look in that one hill?  Don Boudroux at Cafe Hayek expounded on this theme:

I seldom use the term "natural resource." With the possible exception of water, no resource is natural. Usefulness is not an objective and timeless feature ordained by nature for those scarce things that we regard as resources. That is, all things that are resources become resources only after individual human beings creatively figure out how these things can be used in worthwhile ways for human betterment.

Consider, for example, crude oil. A natural resource? Not at all. I suspect that to the pre-Columbian peoples who lived in what is now Pennsylvania, the inky, smelly, black matter that oozed into creeks and streams was a nuisance. To them, oil certainly was no resource.

Petroleum's usefulness to humans "“ hence, its value to humans "“ is built upon a series of countless creative human insights about how oil can be used and how it can be cost-effectively extracted from the earth. Without this human creativity, oil would objectively exist but it would be either useless or a nuisance.

The only real difference between beach sand, worth $0, and a microchip, worth thousands of dollars a gram, is what the human mind has added.

The economist Julian Simon is famous for his rebuttals of the zero summers and the pessimists and doom sayers, arguing that the human mind has unlimited ability to bring plenty our of scarcity.

"The ultimate resource is people - especially skilled, spirited, and hopeful young people endowed with liberty- who will exert their wills and imaginations for their own benefit, and so inevitably benefit not only themselves but the rest of us as well."

A Framework For Wealth Creation

As a final note, it is worth mentioning that the world still has only harnessed a fraction of this potential.  To understand this, it is useful to look back at history.

From the year 1000 to the year 1700, the world's wealth, measured as GDP per capita, was virtually unchanged. Since 1700, the GDP per capita in places like the US has risen, in real terms, over 40 fold.  This is a real increase in total wealth, created by the human mind.  And it was unleashed because the world began to change in some fundamental ways around 1700 that allowed the human mind to truly flourish.  Among these changes, I will focus on two:

  1. There was a philosophical and intellectual change where questioning established beliefs and social patterns went from being heresy and unthinkable to being acceptable, and even in vogue.  In other words, men, at first just the elite but soon everyone, were urged to use their mind rather than just relying on established beliefs.  In this formulation, I use "beliefs" in its broadest possible meaning, encompassing everything from the belief that the earth is the center of the universe to the belief that music has to be sold in stores on physical media There were social and political changes that greatly increased the number of people capable of entrepreneurship.  Before this time, the vast vast majority of people were locked into social positions that allowed them no flexibility to act on a good idea, even if they had one.  By starting to create a large and free middle class, first in the Netherlands and England and then in the US, more people had the ability to use their mind to create new wealth without the encumbrance of artificial state-imposed class limits or mind-numbing regulatory barriers.  Whereas before, perhaps 1% or less of any population really had the freedom to truly act on their ideas, after 1700 many more people began to have this freedom.
  2. So today's wealth, and everything that goes with it (from shorter work hours to longer life spans) is the result of more people using their minds more freely.

The problem (and the ultimate potential) comes from the fact that in many, many nations of the world, these two changes have not yet been allowed to occur.  Look around the world - for any country, ask yourself if the average person in that country has the open intellectual climate that encourages people to think for themselves, and the open political and economic climate that allows people to act on the insights their minds provide and to keep the fruits of their effort.  Where you can answer yes to both, you will find wealth and growth.  Where you answer no to both, you will find poverty and misery.

Even in the US, regulation and the inherent conservatism of the bureaucracy slow our potential improvement.  Republicans block stem cell research, Democrats block genetically modified foods, protectionists block free trade, the FDA slows drug innovation, regulatory bodies of all stripes try to block new business models.

All over the world, governments shackle the human mind and limit the potential of humanity.

Libertarian Plea to the Left

My Princeton college roommate Brink Lindsey, now of Cato, has been raising a moderate rumpus by arguing that the traditional libertarian-Right coalition is stale and that libertarians should look for allies on the left as well.  He called it liberaltarianism.  Fair enough.   I will take a shot at the same plea.

I will use this map of the teaching of evolution in schools by state as a jumping off point.  I can't validate whether it is accurate or not, so I won't reproduce it here, but let's accept it as a fair representation of the diversity of approach to teaching evolution by state, even if you don't agree with the implicit value judgments embedded in the chart.  I will use it to reflect on two points I have made in the past to try to interest the left in libertarianism.

1.  Building complex machinery of state may feel good at first, when "your guys" are in control, but your opposition, or outright knaves, will eventually co-opt the system. As I wrote here:

I am reminded of all this because the technocrats that built our
regulatory state are starting to see the danger of what they created.
A public school system was great as long as it was teaching the right
things and its indoctrinational excesses were in a leftish direction.
Now, however, we can see the panic.  The left is freaked that some red
state school districts may start teaching creationism or intelligent
design.  And you can hear the lament - how did we let Bush and these
conservative idiots take control of the beautiful machine we built?  My
answer is that you shouldn't have built the machine in the first place
- it always falls into the wrong hands.... 

Today, via Instapundit, comes this story about the GAO audit of the decision by the FDA to not allow the plan B morning after pill to be sold over the counter.
And, knock me over with a feather, it appears that the decision was
political, based on a conservative administration's opposition to
abortion.  And again the technocrats on the left are freaked.  Well,
what did you expect?  You applauded the Clinton FDA's politically
motivated ban on breast implants as a sop to NOW and the trial
lawyers.  In
establishing the FDA, it was you on the left that established the
principal, contradictory to the left's own stand on abortion, that the
government does indeed trump the individual on decision making for
their own body
  (other thoughts here).
Again we hear the lament that the game was great until these
conservative yahoos took over.  No, it wasn't.  It was unjust to scheme
to control other people's lives, and just plain stupid to expect that
the machinery of control you created would never fall into your
political enemy's hands.

2.  As public school boards come under sway of the Christian Right, the left should learn to embrace school choice, just as the Christian Right did a generation ago.  As I wrote here:

After the last election, the Left is increasingly worried that red
state religious beliefs may creep back into public school, as evidenced
in part by this Kevin Drum post on creationism.
My sense is that you can find strange things going on in schools of
every political stripe, from Bible-based creationism to inappropriate environmental advocacy.
I personally would not send my kids to a school that taught creationism
nor would I send them to a school that had 7-year-olds protesting
outside of a Manhattan bank.

At the end of the day, one-size-fits-all public schools are never
going to be able to satisfy everyone on this type thing, as it is
impossible to educate kids in a values-neutral way.  Statist parents
object to too much positive material on the founding fathers and the
Constitution.  Secular parents object to mentions of God and
overly-positive descriptions of religion in history.  Religious parents
object to secularized science and sex education.  Free market parents
object to enforced environmental activism and statist economics.   Some
parents want no grades and an emphasis on feeling good and self-esteem,
while others want tough grading and tough feedback when kids aren't
learning what they are supposed to.

I have always thought that these "softer" issues, rather than just
test scores and class sizes, were the real "killer-app" that might one
day drive acceptance of school choice in this country.  Certainly
increases in home-schooling rates have been driven as much by these
softer values-related issues (mainly to date from the Right) than by
just the three R's.

So here is my invitation to the Left: come over to the dark side.
Reconsider your historic opposition to school choice.  I'm not talking
about rolling back government spending or government commitment to
funding education for all.  I am talking about allowing parents to use
that money that government spends on their behalf at the school of
their choice.  Parents want their kids to learn creationism - fine,
they can find a school for that.  Parents want a strict, secular focus
on basic skills - fine, another school for that.  Parents want their
kids to spend time learning the three R's while also learning to love
nature and protect the environment - fine, do it.

Yes, I know, private schools to fit all these niches don't exist
today.   However, given a few years of parents running around with
$7000 vouchers in their hands, they will.  Yes, there will be
problems.  Some schools will fail, some will be bad, some with be
spectacular (though most will be better than what many urban kids,
particularly blacks, have today).   Some current public schools will
revitalize themselves in the face of competition, others will not. It
may take decades for a new system to emerge, but the Left used to be
the ones with the big, long-term visions.  The ultimate outcome,
though, could be beautiful.  And the end state will be better if the
Left, with its deep respect and support of publicly-funded education,
is a part of the process.

Of course, there is one caveat that trips up both the Left and the
Right:  To accept school choice, you have to be willing to accept that
some parents will choose to educate their kids in a way you do not
agree with, with science you do not necessarily accept, and with values
that you do not hold.  If your response is, fine, as long as my kids
can get the kind of education I want them to, then consider school
choice.  However, if your response is that this is not just about your
kids, this is about other people choosing to teach their
kids in ways you don't agree with, then you are in truth seeking a
collectivist (or fascist I guess, depending on your side of the aisle)
indoctrination system.  Often I find that phrases like "shared public
school experience" in the choice debate really are code words for
retaining such indoctrination.

In other words, are you OK if Bob Jones high school or Adam Smith
high school exist, as long as Greenpeace high school exists as well?
Or do you want to make everyone go to Greenpeace high school
exclusively?

I Was Sortof Right

A couple of years ago I made this prediction:

We will soon see calls to bring a tighter licensing or
credentialing system for journalists, similar to what we see for
lawyers, doctors, teachers, and, god help us, for beauticians
.  The
proposals will be nominally justified by improving ethics or similar
laudable things, but, like most credentialing systems, will be aimed
not at those on the inside but those on the outside.  At one time or
another, teachers, massage therapists, and hairdressers have all used
licensing or credentialing as a way to fight competition from upstart
competitors, often ones with new business models who don't have the
same trade-specific educational degrees the insiders have....

Such credentialing can provide a powerful comeback for industry insiders under attack.  Teachers, for example, use it every chance they get to attack home schooling and private schools,
despite the fact that uncertified teachers in both these latter
environments do better than the average certified teacher (for example,
kids home schooled by moms who dropped out of high school performed at
the 83rd percentile).  So, next time the MSM is under attack from the blogosphere, rather than address the issues, they can say that that guy in Tennessee is just a college professor and isn't even a licensed journalist.

Well, despite all efforts by John McCain, we still have free speech on the blogosphere.  But I was almost right, because another country is considering such a proposal -- In France:

The government has also proposed a certification system for Web sites,
blog hosters, mobile-phone operators and Internet service providers,
identifying them as government-approved sources of information if they
adhere to certain rules. The journalists' organization Reporters
Without Borders, which campaigns for a free press, has warned that such
a system could lead to excessive self censorship as organizations
worried about losing their certification suppress certain stories.

Interesting Data on Immigration

Via Kevin Drum, the results from a couple of studies in California:

A study released Tuesday by the Public Policy Institute
of California found that immigrants who arrived in the state between
1990 and 2004 increased wages for native workers by an average 4%.

UC Davis economist Giovanni Peri, who conducted the study, said the
benefits were shared by all native-born workers, from high school
dropouts to college graduates....

Another study released Monday by the Washington-based Immigration
Policy Center showed that immigrant men ages 18 to 39 had an
incarceration rate five times lower than native-born citizens in every
ethnic group examined. Among men of Mexican descent, for instance, 0.7%

This is great stuff, I hope we see more of it, because it takes on two of the more common arguments against immigration.  In particular, its good to see someone taking on the crime angle, an issue I have suspected all along of being more about racial prejudices than true statistics.  This is a particularly telling table:

I previously took on the the meme that immigration causes crime here.  My case for open immigration is here and here.  My proposed plan is here.  Note that I really try to stay away from arguing immigration within the "who is going to pick the lettuce" framework.  I think free movement across borders of people, goods, and services is a basic human right, irrespective of the effect it has on wages or lettuce.

Oddly enough, Drum didn't focus much on the positive results on wages, as he has way too much invested in the whole "erosion of the middle class" thing to acknowledge that immigration might not hurt wages (since if immigration does not hurt wages, neither does free trade or outsourcing).  Mr. Drum says he wants to think about the study.  My prediction is that he will decide the crime study is a good one but the wage study was flawed.

Hilarious Calculus of Liberal Altruism

I had to say that this, from Janna Goodrich as quoted by Kevin Drum, is absolutely hilarious:

Education is one of the best engines for upward mobility and poor
students cannot afford to pay for higher education on their own. Their
families don't have the physical collateral to borrow money in the
private financial markets nor the savings to pay for the tuition
outright....But if we gave poorer students mostly grant-based aid we'd
be asking for the rest of the society to subsidize those who are one
day going to be wealthier than the average citizen. Two different
concepts of fairness or equality are at play here and I'm not sure if
both of them could be achieved at the same time.

Can you just see the liberals getting twisted in knots?  Oooh, helping the poor is good, but if we send them to college and they get rich, then we are helping rich people, and that's baaaad.  Its like that logic problem where a card says "the statement on the other side is false" and on the other side says "the statement on the other side is true."  Only a liberal could take the happy story of a poor kid going to college and getting rich and turn it into bad news.  I never thought about what a problem education was for liberal ethics, in that it converts sainted victims (e.g poor) into evil exploiters (e.g. rich).  Maybe that explains why they oppose school choice?

By the way, I have about zero sympathy for this whole grants in education discussion.  From an incentives standpoint, it is perfectly reasonable to ask people who are getting public money for self-improvement to share the risk with the public through the debt and repayment obligation they take on.  A lot of people today already don't take good advantage of the opportunity they have while in college, and this is certainly not going to get any better if we give them a free ride rather than loans.

The second problem I have with public funding of grants for education is that colleges and their alumni groups can decide to fix this problem privately if they so desire.  My school (Princeton) makes a commitment that everyone who gets into the school, not matter how poor, will get a financial aid package that will make it possible to attend.  And, the financial aid is all in grants such that the student graduates from one of the most expensive schools in the country debt-free (and yes, the incentives problem worries me some).  All with private money.  We are able to do this because our school makes it a priority and our alumni give the money to make it happen.

I know what you are going to say -- Princeton is full of rich people, so they can afford this.  Yes and no.  First, our alumni do pretty well for themselves, but they also have to help fund financial aid for the highest tuitions in the country.  Other schools with lower tuitions have a lower bar to clear.  Second, while Princeton alums may be wealthier per capita, our alumni population, because we are a small school, is probably one tenth the size of a Berkley or a Texas.  As a result, schools like Texas almost certainly have a much wealthier alumni group in total.  But few of them give back.  It's not a priority for them to create financial aid money for incoming students (instead, T Boone Pickens gives $125 $165 million to the OU OSU football program).  So don't come crying to me that students at your schools need government grants -- you could have funded such a program at your school privately if you had made it a priority.

Postscript: My dad ran numerous fund raising initiatives at the University of Iowa for years.  After decades of effort, I think he has finally despaired of getting state school alumni to donate money for something other than the sports program.

Update:  OK, that's what I get for making a throw-away statement without fact-checking.  Boone Pickens actually gave $165 million to the athletic programs of Oklahoma State, not OU.  I got a bunch of aggrieved emails on this.  Sorry.  Being from Texas, I get all that stuff up in the trans-Red-River region mixed up.

Football Coach Salaries

I am not sure I find Nick Saban's $32 million contract with Alabama that surprising.  After all, Alabama considers itself a top-10 program but a series of rejections have made the job tainted goods.  When prestige won't sell, money is always the fall back.   And Saban has learned what most other college coaches have learned -- the NFL is a LOT of freaking work and stress compared to college.

My question is a different one.  My guess is that this makes Saban the highest paid state government employee in Alabama.  Is there any state where a college men's football or basketball coach is not the highest paid state official?

I Only Support Incumbent Protection Once I Became an Incumbent

Readers of this blog know that I consider most campaign finance laws to in fact be carefully crafted incumbent protection acts.  Incumbents in major political offices get millions and millions of dollars in free advertising just from their day-to-day ability to get on the evening news.  This free publicity combined with strong name recognition means that upstarts often have to seriously outspend the incumbent to have a chance of defeating them.  So campaign finance laws act as a powerful protection device for these incumbents, limiting the amount upstarts can spend while in no way limiting the incumbents's ability to use their office (and taxpayer money) to shamelessly promote and publicize themselves.

And there is no one better at using elected office to shamelessly publicize himself than new NY Governor Eliot Spitzer.  So absolutely no one should be surprised at this:

Moving swiftly in his efforts to change the culture of
Albany, Governor-elect Eliot Spitzer said Thursday that he would
unilaterally stop accepting campaign contributions greater than
$10,000, which is less than a fifth of the $50,100 in individual
donations currently allowed by state law.

Mr. Spitzer also said that from now on he would refuse to take
advantage of several notorious loopholes in the state's campaign
finance laws that allow corporations and limited liability companies to
circumvent donation limits by contributing through subsidiaries and
other related entities.

Note that he only took these steps just days after he was elected governor the first time.  Spitzer knows that no one can probably offset the PR advantage he wields, but to be on the safe side, this is the opening shot to make sure that no future challenger is going to have the cash to threaten his position in office.

Generally, Eliot Spitzer irritates the hell out of me.  But I will say for one brief period in college, Spitzer, as the butt of a huge campus-wide joke, brought be great mirth.

Increase Ivy League Capacity

There have been a number of articles of late about college admissions and Asians.  For example, my alma mater Princeton is getting sued by a young man who says the school's admissions standards are discriminatory against Asians  (he was forced to go to Yale instead, which in my mind represents substantial pain and suffering).  David Bernstein at Volokh also had this:

against a lot of other high-achieving math/science kids (and a lot of other Asian students in particular). While she may be admitted to MIT early, I am not convinced she's a shoo-in"”I'd want to see more evidence that she's giving back to the community.

I don't know enough to comment on the Asian issues, but I wanted to make a couple of other points.  First, Bernstein is probably correct in wondering why there is such a focus on "giving back to the community" for an 18-year old girl who appears to be a math genius.  But his question is naive.  I can say from experience that everything on an application for college may be negotiable (e.g. good athletics allows for lower SAT scores) except for community service.  That has become inviolable.  Every college prep school I know have elaborate programs nowadays to make sure their kids get lots of community service hours.  My son, at the age of eleven, missed on his first shot at National Junior Honor Society because he only had about 20 hours of community service.  I can tell you that for college-bound high school kids, community service is longer about volunteering and giving back but about grimly checking off one of the most important boxes for college applications.

My other thought is that you don't have to be Asian to worry nowadays that near-perfect SAT's and grades are not enough to get one into the Ivy League.  As you can see here, placing in the 99th percentile on SAT's only gives one a 1 in 5 shot at getting in to Princeton.  The other thing you can see is that top Ivy's are being honest when they say they want more than just good grades -- you can see at Princeton and Harvard that moving from 91st to 99th percentile on SAT's does little to improve a person's prospect of getting in.  (On the Asian discrimination issue, that means that more than half of the kids in the top 1 percentile of SAT's will get turned down by Princeton, and some of these will be Asians.  Whether that is discrimination or just brutally tough admissions is hard to say).

Which leads me to my main point -- the Ivy League needs to find a way to increase capacity.  The number of kids that are "ivy-ready" has exploded over the last decades, but the class sizes at Ivy schools have remained flat.    For years I have been campaigning at Princeton for this, and I am happy to see they are increasing the class size, but only by a small amount.  Princeton has an endowment larger than the GNP of most countries.  To date, it has spent that money both well and poorly.  Well, because Princeton is one of just a handful of schools that guarantee that if you get in, they will make sure you can pay for it, and they do it with grants, leaving every student debt free at graduation.  Poorly, because they have been overly focused on increasingly what I call the "educational intensity" or the amount of physical plant and equipment and stuff per student.  In this latter case, we have got to be near the limit of spending an incremental $10 million to increase the education quality by .01%.  We should instead be looking for ways to offer this very high quality of education to more people, since so many more are qualified today.

By the way, one of the reasons Ivy League schools don't take my advice is because of the faculty.  The very first thing that the faculty wants is more endowed chairs, more equipment, more office space, etc.  The very last thing most faculty wants is more students that would force them to actually teach more rather than publish and do research.

Postscript:  OK, I will make one comment about the Asian kids thing.  I don't know if what Ivy admissions offices are doing is discriminatory or not.  But I do know that among the white parents of college-bound high school students that I know, there is real undercurrent of anti-Asian resentment.  I can't tell you how often I hear stuff like "Oh of course he does well, he's Asian" or "I don't know if my kid can get into X, all the Asian kids get the spots."  Its a strange, resentful sort of racism I see all the time from parents who would never be caught dead uttering anything untoward about blacks.  There is this funny feeling I get in some of these conversations that it's OK to dislike Asians in a way that would never be perceived as OK for blacks.
