Thank God We Don't Have Cable Neutrality

Time Warner Cable, the owners of the Dodgers local broadcast rights is continuing to battle with local cable channels to be added to their cable package.  Like last year, it appears that no deal will be forthcoming and the Dodgers (and perhaps more disheartening, Vin Scully in his last year) won't be on many TV sets this summer in LA.  Kevin Drum essentially says bravo to the cable companies for opposing the Dodgers bid to jack up basic cable rates in the area.

Boo hoo. They tried everything—everything, I tell you. Except, of course, for the one thing that would have worked: the right to make the Dodgers an extra-cost option, not part of basic cable. Most cable operators see no reason that every television viewer in the LA basin should have to pay 60 bucks a year more in cable fees regardless of whether or not they care about baseball.

And that's the one thing TWC won't do. Why? Because then it will become crystal clear just how few households actually care enough about the Dodgers to pay for them. And that would truly be a disaster beyond reckoning. There's a limit to the amount of sports programming that people are willing to have crammed down their throats!

I actually agree with him, and will add that it is always great to see a progressive acknowledge consumers do actually exercise accountability on businesses.

But I will observe that had we adopted cable neutrality rules** as we have for net neutrality, the cable companies would have found it impossible, or at least much more difficult, to oppose carriage by a pushy and expensive content provider.  It is this sort of intra-supply-chain tug of war that generally benefits consumers in the long run (as it has in LA, at least for Drum) that is essentially outlawed by net neutrality rules which basically declare content providers the victors by default.  As I wrote before:

Net Neutrality is one of those Orwellian words that mean exactly the opposite of what they sound like.  There is a battle that goes on in the marketplace in virtually every communication medium between content creators and content deliverers.  We can certainly see this in cable TV, as media companies and the cable companies that deliver their product occasionally have battles that break out in public.   But one could argue similar things go on even in, say, shipping, where magazine publishers push for special postal rates and Amazon negotiates special bulk UPS rates.

In fact, this fight for rents across a vertical supply chain exists in virtually every industry.  Consumers will pay so much for a finished product.  Any vertical supply chain is constantly battling over how much each step in the chain gets of the final consumer price.

What "net neutrality" actually means is that certain people, including apparently the President, want to tip the balance in this negotiation towards the content creators (no surprise given Hollywood's support for Democrats).  Netflix, for example, takes a huge amount of bandwidth that costs ISP's a lot of money to provide.  But Netflix doesn't want the ISP's to be be able to charge for this extra bandwidth Netflix uses - Netflix wants to get all the benefit of taking up the lion's share of ISP bandwidth investments without having to pay for it.  Net Neutrality is corporate welfare for content creators....

I am still pretty sure the net effect of these regulations, whether they really affect net neutrality or not, will be to disarm ISP's in favor of content providers in the typical supply chain vertical wars that occur in a free market.  At the end of the day, an ISP's last resort in negotiating with a content provider is to shut them out for a time, just as the content provider can do the same in reverse to the ISP's customers.  Banning an ISP from doing so is like banning a union from striking.

** Footnote:  OK, we sortof did have cable neutrality in one respect -- over the air broadcasters were able to obtain crony legislation that cable companies had to carry every locally broadcast channel.  So that channel 59 that you never bothered to watch now get's equal treatment with the NBC affiliate.   This was a huge boon for these stations, and the value of these often tiny stations exploded with this must-carry rule.  Essentially they were given an asset for free, ie position in a cable lineup, that other competitors had to fight for.

Al Gore, as an aside, actually became rich with exactly this game.   It is hard to fight your way into a cable lineup nowadays.  Al Gore did it with this Current TV startup based on his name and a promise of a sort of MTV for politics.  The channel went nowhere and lost a lot of money, but it now had one valuable asset -- placement in cable TV lineups.  So it sold this asset to Al Jazzera, which had struggled to get placement.

Political Correctness Gone Wild

Apparently, the Dire Straits song "Money for Nothing" has been banned from the Canadian airwaves:

The Dire Straits song "Money for Nothing" was ruled by the Canadian Broadcast Standards Council to be "extremely offensive" and thus inappropriate for airing on radio or television because it uses an anti-gay slur.

The decision against St. John's radio station CHOZ-FM in Newfoundland was released Wednesday. In it, the panel ruled that the word "faggot" "contravened the Human Rights Clauses" and its ethics code and is "no longer" permitted "even if entirely or marginally acceptable in earlier days."

This is stupid on its face, and even stupider if the song in question is understood.  If you have never heard the song before, it may seem an odd juxtaposition at first -- why does it alternate between jabs at rock stars on MTV and talk about moving appliances?  Because the song is exactly what it sounds like -- Mark Knopfler overheard some workers in an appliance store watching MTV and heckling the performers they saw for being rich and spoiled and overpaid and not working very hard.

The song is interesting not just because it has a great opening that is fun to play at maximum volume, but because Knopfler is one of those guys on MTV the workers are heckling.  Does he secretly agree with them, is he hurt by them, does he find them funny?   Anyway, the word "faggot" in the piece is essentially aimed at the performers themselves -- they are describing a critique they have received, repeated in all its salty blue-collar flavor.  As such the words feel utterly authentic, perhaps because they are -- Knopfler reportedly grabbed a piece of scratch paper right at the store and started jotting down notes.

I cannot imagine a less offensive use of the word.  There is absolutely no way to read the lyrics of the song and come to the conclusion the word was aimed at gays, or really at anyone else but the author and performer.   I presume by this standard  that Canada expects to ban the entire body of hip hop music?

I could have easily titled this post "the Left and Right converge," because in it I see the Left acting exactly like the religious Right I grew up around in the South that would try to ban any number of books and songs, often out of an incredibly poor understanding of what the story or song was really about.

By the way, the statists among you will be happy to know that this ban only applies to private companies -- the state is still allowed to play the song because, you know, government motives are pure and thereby sanitize any harm that might come from playing this song

Ron Cohen, the CBSC's national chairman, told The Washington Times on Thursday that the decision effectively sets a "nationwide" precedent binding on all private license holders for TV, cable-TV and radio broadcasting. It does not cover the state-run Canadian Broadcasting Corp. or "community and university" stations.

I have seen Knopfler live many times live.  To be fair, Knopfler himself seems to have some sympathy for this position, as I have seen him change the offending word to others in more recent live performances.  I don't know if this is an achnowlegement the word should be changed or he is knuckling under to pressure.    Here is the original video on YouTube.  Here is a live version where faggot is replaced.  Extra bonus cameo - Clapton in a pink suit.
Postscript: It is a fairly commonly-known bit of trivia that the first song played on MTV was "Video Killed the Radio Star."  But this was new to me:

When MTV Europe began airing in 1987, "Money for Nothing," which begins with Sting's opening falsetto whisper "I want my MTV," was the first video played.

Will iTunes kill Albums?

Video killed the radio star (appropriately the first video shown on MTV) but will iTunes kill albums?

I was driving today listening to Pink Floyd's Dark Side of the Moon, which I ripped in its entirety to my mini iPod.  I noticed the iPod staggered a little bit on the song transitions, which are seamless on the CD.

And oddly, this got me thinking about the revolution in digital music and what effect it might have on albums.  Back in the 50's and early 60's, the rock/pop music marketplace was dominated by singles.  A great visual demonstration of that era is the "what's on the flip side" scene in Diner between Kevin Bacon and Daniel Stern, a scene that makes no sense to later generations.  Albums, to the extent they were purchased, were merely collections of singles.

A revolution, at least in the world of rock & roll, began to occur in the mid-1960's.  Many folks point to Sgt Pepper by the Beatles as the first concept album, where the songs hang together in a way that the album was greater than the sum of the parts (note that this had always been true in jazz, and of course classical -- but it was new to the rock/pop world).  Over time, many rock albums were produced that were true albums.  Even when the songs don't follow a theme (as in the Moody Blues Days of Future Passed) or tell as story (as in the Who's Quadrophenia), there are many albums I think of as albums, where I can't seem to enjoy the single when it is taken out of context of the other songs (including Fleetwood Mac's Rumors and Genesis's Trick of the Tail)

Pink Floyd, however, probably pursued the album more than any other band.  Few songs from Pink Floyd albums like Wish You Were Here or Dark Side of the Moon or of course the Wall even make sense on their own, any more than a single chapter ripped from a book will be viable on its own.

Today, we may be on the front end of a trend where the market moves back to singles, as market models like iTunes gain traction and put emphasis back on individual songs that have to stand alone.  My son, for example, does not buy albums - he buys individual songs off iTunes.  The only difference from the 50's is that there are no flip sides.

Or, it may be that we are on the brink of still yet another medium, maybe of third parties mixing together tracks from multiple artists into custom collections, much like people have been doing for their friends for years, but with wide open new distribution channels.
